Cutler revealed that Presi
dent Elsenhower in 1054 start
ed the circulation of papers
and agenda In advance of cabi
net meetings. Before that the
cabinet had no regular written
record of Its decisions.
Cutler said the new routine
may have removed "some of
tho informal charm" but It
made tho cabinet "a more re
sponsive organization to the
President's wishes."
He said that administration
officials now rely on more
thnn 80 different statutes,
exccullvo orders and regula.
tlons to withhold or restrict
the disclosure of Information
to the public or press.
Federal department and
agency officials actually don't
know amid this welter of
overlapping laws "Just what
authority they actually have
to withhold anything from
anybody or to disclose any
thing to anybody," Hennlngs
declared.
The statement by Hennlngs
accompanied an 80-page re
port by his Senate subcommit
tee on constitutional rights
which studied the actions of
all 50 states in the field of
public records statutes.
Useful Background
Hennlngs, chairman of the
subcommittee, said the collec
tion of Information about state
laws could serve as useful
background toward formula
tion of a federal public rec
ords law.
Such a comprehensive fed
eral law, he said, could be pat
terned after the best features
of state laws to "spell out
more precisely the duties of
federal officials to disclose
government information."
The subcommittee survey
disclosed that 11 states have
no laws on the books govern
ing the right of inspection of
public records. The states
were Maine, Maryland, Mis
sissippi, New Jersey, Ohio,
Rhode Island, South Carolina,
Texas, Vermont, Washington,
and Wyoming. .
Laws Vary Widely
The other 39 stotes hod
some form of right-to-know
laws or court Interpretations,
although they varied widely
In scope.
Hennlngs said Investiga

"haphazard, Indecisive with
holdings and restriction of in
formation by tlie executive de
partments and agencies,"
He called It a pattern
"which Indicates incredible
confusion" on the part of fed
eral executive officials.
In addition to studying
problems of withholding of In
formation from the pubile and
press, Hennlngs sold h 1 s
group also is doing studies of
two related Issues - the pow
er of the President to deny In
formation to congress, and
Judicial secrecy in tho federal
