They said he landed in the Havana outskirts early this morning in a small Apache plane. Cuban police opened fire on the plane when it landed and Duke was killed by four bul lets, the reports said. Third Plane Destroyed The aircraft was the third American-piloted plane de stroyed in Cuba on bomb or pickup missions in the past three months. Reports said Duke's plane was sighted in the air by po lice patrol cars along the high way between Baracoa and Ma riel, just west of Havana, and was pursued. When Duke landed near the town of Jaimanitas to pick up the three persons, the reports said police from the patrol cars opened fire and the pilot was killed. The three, who were de scribed as. "fugitives from re volutionary justice." appar ently were uninjured. Washington (UPH The gov ernment said today that Mat thew Edward Duke, reported killed when his plane landed near Havana today, was one of 22 persons ordered not to make unauthorized flights to Cuba. The Immigration and Naturalization Service said Duke, West Palm Beach, Fla., was served with a notice last Dec. 2 ordering him not to go to Cuba by private aircraft. The State Department launched an investigation of the reports, carried by Cuban radio stations, that Duke was shot and killed when he land ed on the outskirts of Havana in an attempt to pick up two men and a woman. Seek To Prevent Flights The Immigration Service, the Federal Aviation Agency and the FBI launched a joint effort last fall to prevent ille gal flights from Florida air ports to Cuba. Only last week, a federal Grand Jury in Miami indicted the pilots of a plane shot down by Cuban authorities early this year. The Grand Jury charged that one of the pilots engineered the flight in a plot by the Fidel Castro gov ernment to embarrass the United States. UO Faculty Votes ROTC Status Change Eugene (UPD A resolution that would do away with the compulsory ROTC program at the University of Oregon was passed here Wednesday night by the university faculty. The resolution requests the president of the University of Oregon to take action with the State Board of Higher Educa tion to provide that the Air Force and Army ROTC two year basic courses be changed from a required to optional status. Servicemen ENTERS NAVY Gary G. Legler, son of Mr. and Mrs. Alexander Legler, route 2, Central Point, recent ly was sworn into the Navy in Portland at the rating of seaman. A member of the National Guard for three years and an Army reservist at the time of enlistment, Legler is undergoing basic recruit training in San Diego. The White City hearing will be in the courthouse on Thurs day, May 26, and the West Side area on Wednesday, June 1, in the West Side school. Ron James, planning com-i mission president, pointed out that the proposed White City zoning is "slightly unique'' since the people of the area have suggested a building code to go with the zoning and have asked for clarifica tion of what is agricultural property. Last night, C. C. Hoover and sons, subdividers of the area, submitted an amend ment of the petition for zon ing designating what should be considered farm land. This would be land which has one fourth acre of garden or more, one-fourth acre of grazing. 20 or more chickens, one or more horses or cows, two or more hogs, etc., and any other gen eral agricltural use, Bud Homer explained. Agrees with Hoover Planning C o m m 1 s sioner Bill Duggan, of Sams Valley, agreed with Bud Hoover that building inspection should be made only when called for or when there is a violation. They both said it would be too time consuming and ex pensive for scattered regular inspections throughout the county. Both said enforce ment of deed restrictions by the subdividers should be enough. The building inspect or would be called only when the property owners refused to comply. Hoover said a thorough electrical inspection is made for each house constructed on their subdivision, a sanita tion inspection on request and a series of inspections by them to see that the prop erty owners comply with deed restrictions. Some planning commission mem bers thought the building code should also include farm structures. James said the planning commission would do any thing it could to reach an un derstanding with tile Lull family which owns a granite quarry ill the West Side area proposed for zoning. This won't put tile Lulls out of business, he said. The quarry can continue to oper ate under the clause in the proposed zoning ordinance al lowing non-conforming uses of land if the use is already established when the ordin ance becomes effective. Wil bur Lull replied that his fam ily feels any reslnctions "would present a hardship." Can Request Change Commissioner Jerry Lath am said property owners can request a change in the zon ing regulations if they can show proposed use of their property will not damage oth er property in the same area. The proposed ordinance could be reworded, to include fu ture uses, he said. Summing up the recent meeting ill the West Side area on lite proposed zoning there, James Smith said main objec tions were that people thought they would not be allowed to keep 4-H animals, riding horses, a cow or two, or a flock of chickens; 6,000 square foot lots were thought too small, and a zoning ordinance would be an infringement on personal rights. Favor Building Code Reporting on the recent meeting in the Sams Valley area on a zoning ordinance proposed for that area, C. W. (Bill) Duggan, said, "all the people in the Sams Valley district are in favor of a build ing code." Members of the building code subcommittee are to meet today or Friday to dis cuss the proposed code furth er and iron out some details discussed at last night's plan ning commission meeting. The code will be discussed in detail either at the next meeting or two months from now, James said. Commission er Clifford Lovejoy is chair man of the subcommittee. Among reports given by Ihe subcommittee on subdivisions was that a request has been made of the state health de partment to send a man to help establish minimum stand ards on evaporation fields. This is an experiment work ed out by Orie Moore, Jack son county sanitarian, in co operation with the Hoovers in the White City area. The soil in that area makes septic tank drainage fields unsatis factory, generally, so septic tank fluid is being run out into an area covered with a mound of sawdust or gravel. Unusual Profits In Storage Charged Washington 'I I'll - General Account ing Office Auditors said today some warehouse men have made profits up to ha per cent on each bushel of surplus grain stored under the government's one-rate pay ment policy. The auditors said that in handling grain, some ware houses netted profits ranging up to 448 per cent of their handling costs. Sen. Stuart W. Symington 1D-M0.) said it was "incred ible" that the Agriculture De partment would not adjust Its rales to prevent what he termed "very high profits" in the surplus program. This grain storage policy usually has provided "rates of net profit greatly in excess of the profit allowances that we have noted generally in our audits of fixed-price contracts negotiated by Ihe govern ment," the GAO report said.
