S District Judge Claude MeCol loch, 71, who died in a Port land hospital Wednesday. He retired as ch ief Ore son federal judge last Jan. 1 be cause of ill health and was suc ceeded by John F. Kilkenny, .renaieton. Bern in California Judge McColloch was horn in Red Bluff, Calif., and at tended schools here, Chicago University and Stanford. He was admitted to the Oregon bar in 1909 and practiced law in Baker from 1909 to 1913, where he married Erma Clif ford in 1912. Elected to the state Legisla ture at the age of 23, he went into law partnership with re tired Gov. Oswald West. Mc Colloch rose to be state Demo cratic chairman in 1936 after he had moved to Klamath Tails. Xm&d By Rooteyelt President Roosevelt the next year named him to the federal bench. The jurist's father was the late Judge C. H. McCol loch of Baker county. - In a joint statement, U. S. Oregon District Judges Gus J Solomon,. William G. East and Kilkenny said Judge McCol loch "was studious and schol arly, and was widely known as an outstanding jurist. We are saddened by the death of our colleague and friend . . . Survivors, besides the wid ow, include a brother, Frk C. McColloch, Portland. Extradition of Suspect Planned Long Beach, Calif. - (UPD -Kenneth Schilling, 29-year-old Olympia, Wash., pipefit ter, refused Wednesday to waive extradition to return to Washington and face rape murder charges in the death of a nine-year-old Centralia girl.: Police detectives said they talked Wednesday to Cen tralia sheriffs officers and asked that extradition pro ceedings be instituted against Schilling immediately. Schilling is held as a fugi tive from Washington in con nection with the rape-slaying of Sherry Edgell. Her body was found Friday near an air port Jn the vicinity of her home. The Lewis county sher iffs office issued an all-points bulletin, for Schilling. Schilling was arrested Tues day night in a bar and offered no resistance. Police here said they knew nothing of the crime and had asked Lewis county deputies to send detectives to southern California to carry out the investigation here. They said they did not know what Lewis county officers would do. - Officers said Schilling told them he came here on. Sept. 27 and sold his car for $100 while staying with a friend. Peterson Urged To Oppose Porter Salem - (UPD - State Repub lican Chairman Peter Gunnar said Wednesday that Ervin L. Peterson, assistant secretary of agriculture, is being urged to run for Congress against Democratic Rep. Charles O. Porter. " .. . Peterson, a former dairy man from Coos county, was Oregon agriculture ? director before his federal' appoint ment. He now is in charge of national forests. , Gunnar said he had heard a. number of workers in the fourth district were thinking of drafting Peterson as a Re publican congressional candi date. Peterson is 50 years old.' County Judge Emile .Larkin and Commissioners Walter Schmidt and Melvin Hawkins, joy-riding in it at the time, were stuck near the third floor until an employe of the elevator company worked the cab to the main floor where the , doors opened to free free them.
