The girl, whose .f name was withheld, testified in felony court Wednesday that ,she made the promise to Jacob Bethea, 16, when he made a move to go further , during a 10-minute kissing" session with her. She said she only made the promise to get rid of him, that she was "only fooling him." Mysfery Writer Helps Life Termer Oklahoma City, Okla.-flJPD-Mystery writer Earl Stanley Gardner planned to make an unprecedented court appear pearance today seeking a new trial for a Texas man serving a life term for kidnaping. He is scheduled to ask U.S. District Judge W. R. Wallace to give Marion Isom Bowling, 43, of Wichita Falls, Tex., a new trial, apparently on the basis of new evidence uncov ered by t h e magazine-sponsored "Court of Last Resort." Gardner ' declined to com ment on the case. He said he wanted to, avoid "trial by newspaper.". But he said the Bowling case will be the first time since the "Court of Last Resort" was formed in 1848 that any of its members have appeared in court. He said they normally work through an appeal to the people. , . Bowling and Foster Bowen were convicted by a federal court jury at Ada, Okla., on March 4 1957 of kidnaping and criminally assaulting a 22-year-old Duncan, Okl a., waitress. JORDAN GETS GRANT Amman, Jordan -0PD- The LBritish government has given Jordan $1,400,000 to help complete 'a new desert road to Aqaba, a Red Sea port on the Gulf of Aqaba, a British embassy spokesman an nounced Wednesday. The road insures Jordan free access to the port. Other roads to Aqa ba cut through Syria and are subject to a blockade. Ashland City Band Opens Concerts Ashland-The Ashland city band opens its annual series of summer concerts at 7:30 o'clock tonight in Lithia park's Butler memorial band shell. The band is under the direction of Dr. Herbert Cecil of the Southern Oregon col lege music faculty. Tonight's concert will not feature a guest soloist, but will consist entirely of selec tions by the 70-member band. Numbers will include "If Thou Be Near" by Bach, "Around the World in Eighty Days" by Victor Young, and "El Capitan" by John Phillip Sousa. Duncan following a sanity hearing Wednesday. She was sent to the State hospital after her husband,' Archie Goodwin,' was found fatally injured in the back yard of their home by ham mer blows. Dr. Hope Plymate, mem ber of the psychiatric staff of the hospital, and Dr. W. J. Stone, county health officer, both testified that Mrs. Good win was mentally ill and in need . of psychiatric treat ment.
