Oregon, did on the 5th day of February, 1959 by resolution, initi ate proceedings to vacate the fol lowing described portion of Clark Street within the City of Medford as the same is designated and de lineated on the official plat thereof of record, to-wit: Clark Street between Cedar Street and a point on the Easterly line of the Southern Pacific right of way. being a point approximately 350 feet West of the Easterly line of Central Avenue in the City of Medford. Oregon, and did provide for a public hear ing to be held at the hour of 7:30 o'clock P.M , on the 2nd day of April, 1959 in the Council Chambers of the City Hall in the City of Medford, Oregon for the purpose of considering the vacation of and adoption of an ordinance vacating said Clark Street as above described and for the purpose of hearing and considering any objection or remonstrance thereto which may be made in writing and filed with the Recorder prior to the time of said hearing by order of the Council of the City of Medford. SECTION 2 It is the intention of the Council to assess the prop erty fronting on the street wherein said water main is iaia as Herein before last described its proportion ate share of so much of the cost thereof as equals the special Dene fit which will result to said prop erty from the use of said water main as a lateral water main of such size as would be required to supply the property fronting on said street in case said water main was not so used and the Council has and loes here determine that the sum of $2.35 per front foot is the amount ot sucn special Dene fit and the proportionate cost of such a lateral water main to such property as afresaid and intends to assess said amount against such adjacent property on account there of. SECTION 3. The Council will meet at the hour of 7:30 o'clock PJvl. at the auditorium of the Jackson County Court House on the 19th day of March, 1959, at which time and place all protests of said assessment, as here inbefore provided for, will be heard. SECTION 4. The Recorder is hereby .directed to serve notice hereof upon the property owners aforesaid by publishing this resolu tion 3 times in a newspaper pub lished and of general circulation in said City and by posting the same in 5 public places in said City; said publication and said posting to be not less than 10 days before the date of said meeting.
