Judge Nominating Commission Set Up Under Senate Bill Salem-UPD-Creation of a judicial nominating commis sion to recommend judicial appointments to the governor is provided in a proposed con stitutional amendment con tained in Senate Joint resolu tion No. 8 read for the first time Moday. The resolution was intro duced by the Senate Commit tee on Judiciary. If approved by both houses, the amendment would be re ferred to a vote of the people at the next general election. Seven Members The proposed nominating commission would be com posed of the chief justice of the State Supreme Court, the president of the Oregon State Bar, a member of each house of the Legislature and three persons appointed by the gov ernor. When a vacancy occurred in the office of any judge, the commission would nominate three qualified persons who have signified intention of ac cepting the appointment. The names would then be submit ted to the governor for ap pointment.' - - -Deemed Appointed All nominations made by the commission would be by an affirmative vote of at least four members. If the governor fails to make an appointment within 30 days, the commis sion may make one nomina tion and file it with the sec retary of state's office. Such CENTRAL POINT Two Old Flags Found By DORIS HUGHES Central Point - Two old United States flags were found by Donald Lacy re cently. Lacy's home was damaged by fire Aug. 17, and recently he has been tearing down the old structure to clear the property. Between the walls of the oldest part of the house, Lacy found the flags. He also round a copy of the Capital Journal, ' dated in 1893. The Salem, Ore., newspaper was then a weekly publication. The flag has 38 stars ar ranged in circles within a circle. Dinner Pilot Missing on Reno to Vale Trip Salem -UPB- An Oregon pi lot was missing today on a flight from Reno, Nev., to Vale. - . Earl Snider, director of the State Bureau of Aeronautics, said puilot John N Miller left Reno at 9:43 p.m. and was due in Vale at. 1:13 ajn. todav. He said Miller contacted the Boise communications center and reported he was lost in an overcast. It was believed the plane may have gone down about 120 miles southwest of Boise, in the general area of Rome, Ore. Search planes were to take off today as soon as the weather permitted and ground parties also were to take part in the hunt. A feature of the proposed amendment is that, if ap proved, a person holding an appointment would have no opposition when he seeks re election. Should he be defeated, de spite the fact that he is run ning alone for the office, the nominating commission would make nominations and submit three names to the governor, as was done in the first in stance. Repeal of all but one section of the relatives' responsibility acxis proposed in a bill in troduced in the Senate. This repeal act is similar to one introduced in 1957 by Sen. R. F. Chapman (D-Coos Bay) and others, but which went down to defeat. - The bill does not disturb the section which gives the county or state first lien on a home owned by a deceased welfare recipient to cover wel fare payments made to the persons during their lifetime. All remaining sections deal ing with responsibility of rela tives to aid persons in need would be repealed by the pro posed act. Besides Chapman, Sens. Communism Leaders Meet For Congress Moscow -UPD- The leaders of world Communism assemb led here Monday for the 21st special congress of the Soviet Communist party which be gins today in the Kremlin. Two U.S. delegates were pres ent for the first time since be fore World War II. The non-Russians included Chou En-lai of Red China; Premier Nam II of North Ko rea; Ho Chi Minh of North Vi et Nam; Palmiro Togliatti of Italy and Jacques Duclos of France. They were "fraternal delegates" v with no voting rights. Americans Listed The Soviet press listed the Americans as James Jackson and Moses Shield, members of the National Executive com mittee. They were able to travel freely to Moscow be cause of a U.S. Supreme court ruling permitting them to get passports. Jackson is one of the Com munists whose conviction un der the Smith act was revers ed by a U.S. appellate court Moses Shield apparently is an incorrect translation from the Russians; Communist sources in New York thought the del egate was Morris Childs of Chicago, a former member of the party executive commit tee. Long Speech Anticipated The chief item on the agen da was Premier Nikita S Khrushchev's new seven-year Dlan to outstrip the .United States in industry and agri culture. He is expected to out line this in an opening speech Tuesday that could run from four to eight hours in length The Congress also might hear a report by Deputy Pre mier Anastas Mikoyan on his trip to' the United States and new castigation of the anti party" group of Vyacheslav M. Molotov, Nikolai Buganin, Georgi Malenkov, Lazar Kag- anovich and Dmitri Shepilov. Virginia Governor Calls Legislature On Integration Richmond. Va.-flJPD-Gov. J, Lindsay Almond, in a formal proclamation mailed Mon day, ordered the Legislature to convene at noon Wednes day in a last-ditch bid to head off school integration in three cities. In his call for a special ses sion of the Legislature, Al mond did not announce e specific program, but inform ed sources believe his recom mendations will include some form of tuition grants to pro vide private schoolmg in tne affected areas. Leaislators Alerted The mailing of the procla mation was a formality. Actu ally. Almond alerted the 140 legislators Sunday night to come to the Capitol to pass some sort of stop-gap pro gram and shore up the state's segregation defenses. Laws Struck Down Federal and state courts last week struck down Vir ginia's "massive resistance laws including one under which Almond last fall closed schools in Norfolk, Charlottes ville and Front Royal to cir cumvent integration. By DICK HUMPHREY Salem - (UPD - Oregon legis lators are generaly respond ing to the report of Dr. John F. Sly on revision of Ore gon's tax structure with a "yes, but . . ." reaction, a United Press International poll showed today. Most of the legislators thought that at least some of the Sly recommendations were good. Many, chiefly Re publicans, favored, breaks for United States Takes Hard Look At Philippines Washington-(UPD-The United States has taken a hard look at its relations with the Phil ippines, seriously strained by a series of problems, disagree ments and a mutual dissatis faction. U. S. Ambasador Charles E. Bohlen, called home from Manila last week, began con sultations at the State Depart ment on issues threatening the normally warm friendship between the two nations. Romulo Summoned Bohlen's talks coincided with similar conferences in Manila by Carlos P. Romulo, Philippine ambassador to Washington who was sum moned home in a parallel move. Bohlen planned to report to Secretary of State John Foster Dulles, Assistant Secretary Walter S. Robertson and, later, to President Eisenhow er. He also had a tentative date with a Senate Foreign Relations Subcommittee. The main issues between the two countries are: -Philippine complaints that the United States is dragging its feet in furnishing the eco nomic development loans promised by President Eisen hower during Philippine Pres ident Carlos P. Garcia's visit here last June. Only about $45,000,000 of an anticipated $200,000,000 in loans has ma terialized. -Philippine demands for greater criminal court juris diction over American troops stationed in the islands than the United States has sur rendered to its NATO allies and Japan. Seeks Higher Tax -Philippine insistence on raising its special import tax on American goods to 17 per cent, although the U. S.-Phil-ippine trade agreement pro vides for a maximum 15.3 per cent import tax. -Philippine resentment against U. S. insistence on matching Philippine efforts in defense spending as a condi tion for getting more acceler ated deliveries of U. S. arms aid. -Demands by leading Phil ippine congressmen for abro gation of part of the military aid agreement which requires the Philippines - like all other arms aid recipients - to pay the local costs of the U. S military advisory group. -Threats by some national istic Filipinos to turn to Com munist or other nations for help, a threat viewed in some quarters as part of a general pressure campaign to force special concessions from Washington. Hunt (R Woodburn) said "it appears that both Democrats and Re publicans will be able to live with the Sly tax report." But he added: "Whether or not the ' 50th legislative session will follow his suggestion is problematical." Several other lawmakers were skeptical that much change in Oregon's tax struc ture could be made this time. Rep. Clarence Barton (D Coquille), chairman of the House Tax Committee, said he thought most of the Sly conclusions good, but would not go along with the Sly recommendation of no pers onal tax on capital gains if the asset is held longer than one year. Barton thought this might result in high revenue losses that would have to be made up by the majority of Oregon taxpayers. He estimated the loss at $6 million or more. Flesher Report Noted Most legislators thought a change to new excise taxes, new basis from income tax or a consumer sales tax or a combination of these taxes would come slowly. Most legislators had not made up their minds on this report because they were not yet familiar with it. A good many legislators were for the report, but not in a red-hot way. Rep. Dick Hoyt (R-Corval-lis) said "some sort of junior college and vocational pro gram is needed to relieve the load on higher education and such programs could well be partly financed with state funds." Several legislators thought more study was needed. School Support Discussed On another important ed ucation matter increasing basic school support from $105 to $120 per census child, legislators were very skepti cal of whether it could be done this session. Many agreed it should be done, but didn't see how it could be done without raising present taxes or creating a new tax. Sen. Francis Ziegler (R Corvallis) said he had a bill to provide $120 with the $15 raise going as an offset against property taxes. Sen. Ben Musa (D-The Dalles) observed that "schools too, must learn to re-evaluate their fiscal requirements."
