materially interfering with the use
thereof for the purpose of a water
main, the purpose for which it was

You' are further notified that on
the 25th day of June, 1958, a Decla
ration of Taking of the estates
hereto set out in the lands described
and designated as Parcels 1, 2, 3
and 4 was filed in the above Court
in accordance with said Act of
February 26, 1931 (46 Stat. 1421),
and simultaneously therewith there
was deposited in this Court and
cause the estimated just compensa
tion for the taking of said estates
in said lands.
You are further notified that if
you have any objection or defense
to the taking of your property you
are required to serve upon plain
tiffs attorneys at the address here
in designated within four weeks
after the date of the first publica
tion of this Summons (Notice), an
answer identifying the property in
which you claim to have an in
terest stating the nature and ex
tent of the interest claimed, and
stating all your objections and de
fenses to the taking of your prop
erty. A failure so to file and serve
an answer shall constitute a con
sent to the taking and to the au
thority of the Court to proceed to
hear the action and to fix the just
compensation and shall constitute
a waiver of all defenses and objec
tions not so presented.
You are further notified that if
you have no objection or defense to
the taking you may serve upon the
plaintiff's attorneys a notice of ap
pearance designating the property
in which you claim to be interested
and thereafter you shall receive
notice of all proceedings affecting
the said property.
You are further notified that at
the trial of the issue of just com
pensation, whether or not you have
answered or served notice of ap
pearance, you may present evidence
as to the amount of compensation
to be paid for the property in
which' you may have an interest
and you may share in the distribu
tion of the award.
This summons (Notice) is served
upon you by order of the Honor
able William G. East, Judge of the
above entitled Court, made and en
tered on the 8th day of December,
1958, by the publication thereof for
four successive weeks in the Med
ford Mail Tribune, a newspaper
printed and published in the city of
Medford, Oregon, in the County of
Jackson, and of general circulation
in said county wherein said lands
are located, the first publication of
this Summons (Notice) being made
in the issue of said newspaper on
