Practical Joker Is Often Liable For Results of Joke A fortune teller told Mag gie, who was nearly 50, that her ancestor had buried a pot containing gold coins some where in the vicinity of the Old homestead. Up to this time Maggie had been suc cessfully making her living as a saleslady. It was general knowledge, however, that about twenty years earlier she had been confined in a mental hospital for treatment and care. After learning about the supposed gold coin Maggie became very intent on find ing it. With the aid of some friends she spent about three months digging in likely places. Her neighbor gave his permission for her to dig on his place. In fact, he encour aged her to do so. After she had been digging around his trees and the foundation of his house, however, he be came a bit irritated and de cided with others in the area, to play a joke on her. Quite Excited The conspirators obtained an old metal pot, filled it with wet dirt and stones, and put a double lid on it with a note between the two -lids with instructions to the find er. They buried the pot in a place where they knew Mag gie had planned to dig. The news got around and a num ber of people were on hand when she found the pot. She removed the first lid and the instructions told her to have it opened at the bank in a nearby town and to have all the heirs of the ancester pres ent. Maggie was quite ex cited. She prevailed upon a judge to be at the bank. Many people gathered and the pot was opened. When Maggie saw what was in the pot she became hysterical and accused those around of stealing her gold. She suffered a great deal of humiliation and mental angu ish and became ill. Within two years she died. Prior to her death,, how ever, she began legal action seeking damages from those who played the joke on her. Her heirs continued the ac tion. Defendants argued that they did not intend to do her any harm and were merely playing a joke. The Supreme Court of Louisiana decided that they must pay $500 in damages. The court pointed out that Maggie, if she were still alive, would be entitled to substantially more. Gunpowder and Tobacco In an earlier case from Illi nois a store owner mixed some gunpowder with pipe tobacco and put it in a jar from which plaintiff usually filled his pipe. The plaintiff was injured later while light ing his pipe. The court held the store owner liable for the injuries, even though he was merely playing a "practical joke." Courts decided relatively few of these cases. Those that have been decided, however, are pretty much in agreement that the "practical joker" who plays these rather cruel jokes on his fellow man, should be made to answer in damages for injuries inflicted as a result of such jokes.
