0 lEGAt NOTICES ORDINANCE NO. 7B9S AN ORDINANCE declaring the assessment on property benefited for the cost of constructing paving, curbs, gutters and driveways on Kennet Street from Court Street to Riverside Avenue in the City of Medford. Oregon: and directing the Recorder to enter a statement thereof in the docket of City Liens ar.d publish a notice thereof as re quired by the Charter. THE CITY OF HE D FORD DOTH ORDAIN AS FOLLOWS r Section 1. WHEREAS, the City Council did heretofore by Ordi nance declare its intention to con struct paving, curbs, flitters and driveways on Kennet Street from Court Street to Riverside Avenue In the City of Medford. Oregon: and to assess the cost thereof upon each lot or part thereof adjacent to and benefited by such improve ment its proportionate share of the cost of said improvement, and did fix the time and place for. hearing protests against the construction of said improvement, and the assess ment of the cost thereof, as afore said, and WHEREAS said Ordinance was dulv posted and published as re quired by the Charter of the City; and WHEREAS a meeting of the Council was held at the time and place fixed in said Ordinance for the purpose of considering any such protests, but no protests were at such time, or at any time, made to, or received by the Council to the construction of said improve ment, or the assessing of the cost thereof, as aforesaid, and said Council has considered the matter and deeming that said construction of said improvement was and is of material benefit to said nty, ana that all the property to be assessed therefor will be benefited thereby to the extent of the probable amount of the respective assess ments to be levied against said Sroperty, did order the construe on of said improvement; and WHEREAS, the cost of said Ira provement has been and hereby is determined to be the sum. of 8 544 37. NOW. THEREFORE, it is hereby determined that the proportionate share of the cost of construction of said improvement, on each par eel of property adjacent to said im provement and benefited thereby is the amount set opposite the de scription of each piece or parcel of land below, and that each piece or parcel of land benefited by the construction of said improvement, to the full extent of the amount so set opposite such piece or par cel and that the respective amounts represent the proportional benefits of said improvement to said respec tive parcels of property, and the . THE CITY OF MEDFORD DOTH ORDAIN AS FOLLOWS: Section 1. WHEREAS, the City Council did heretofore by Ordi nance declare its intention to con struct paving, curbs, gutters and driveways on Beatty Street from Kennet Street to McAndrews Road ir. the City of Medford. Oregon; and to assess the cost thereof upon each lot o part thereof adjacent to and benefited by such improvement its proportionate share of the cost of said improvement, and 'did fix the time and place for hearing protests azainst the construction of said improvement, and the assessment of the cost thereof, as aforesaid; and WHEREAS said Ordinance was duly posted and published as re quired by the Charter of the Cit; and WHEREAS a meeting of the Council was held at the time and Slace fixed in said Ordinance for iw purpose of considering any such protests, but no protests were at such time, or at any time, made to, or received by the Council to the construction of said improve ment, or the assessing of the cost thereof, as aforesaid, and said Council has considered the matter and deeming that said construction of said improvement was and is of material benefit to said City, and that all the property to be assessed therefor will be benefited thereby to the extent of the probable amount of the respective assess ments to be levied against said property, did order the construc tion of said improvement; and WHEREAS, the cost of said im provement has been and hereby is determined to be the sum of $4,303.95.
