This column is prepared at a public service by the College of Law, Willamette University, Salem, to ex plain basic legal principles, not to provide legal advice. Federal Courts Cannot Admit Wire Tapping Sam Brown is charged with violating a Federal statute, Evidence was obtained by Federal officers through the tapping of Brown's telephone wires; but is this evidence ad missible in the Federal court? The Federal courts have held that the tapping of tele phone wires is not an illegal search or seizure, therefore does not fall within the scope of the Fourth Amendment to the Federal Constitution. Right of People The Fourth Amendment provides: "The right of the people to be secure . . . against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, sup ported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." "Olmstead v. United States" decided in the U. S. Supreme Court in 1928 was the leading case holding that evidence ob tained by federal officers through the tapping of tele phone wires was admissible in a Federal court. In 1934, however, Congress enacted Section 605 of the Federal Communications Act which says in part: "No per son not being authorized by the sender shall intercept any communication and divoulge or publish the existence, con tents, substance, purport, ef fect or meaning of such inter cepted communication to any person." Not Admissable Under this statute evidence obtained through wire tapping of a telephone by Federal of ficers is not admissible in a Federal court. The "wire-tap" evidence against Sam Brown cannot therefore be admitted. This statute does not apply to the states. Evidence obtain ed by state officers through wire tapping is, generally, ad missible in a state court. How ever, many states, including Oregon, now have statutes prohibiting or restricting the use of wire tapping. A few of these states expressly forbid disclosure of the wire tapping evidence.
