L-J Greatest Problem Concerning Family Desertion Falls on Court This is the third in a se ries of five articles on fam ily desertion. By R. L. FISHBECK ; Family desertion is a many- sided problem that requires more than imprisonment of the deserter, and giveaway programs to his wife and fam ily, if it is to be solved. ' The greatest burden of cop ing with the problem falls on the courts, whose job it is to try deserters and enforce sup port agreements. But how should the courts fulfill their obligation? Since the evolution of state reciprocal support legislation, the apprehension and punish ment of deserters has .become more effective. Deserters can no longer run away from their responsibilities merely by slipping from state to state. But the mere exist ence of this new type of leg islation will not insure its success. 1 Cooperative Effort The states must put forth an intensive, cooperative ef fort, to get the most out of the reciprocal support law. Enforcement of the law must be immediate and swift, if it is to be of real value to de serted persons. The deserter usually funs away without warning, leaving the wife to feed and clothe her family with little or no income. What is needed to bridge the gap between - the family, the laws and the courts? One connecting system that has been tried and proved is the family court of Toledo, Ohio. This court has jurisdiction over all family matters from delinquency to divorce, in cluding desertion. The first family court, with jurisdiction over both adults and children, was created in Hamilton county, Ohio, as a division of the court of com mon pleas. For the first time divorce and alimony cases, and all others arising under the juvenile court act, includ ing cases of failure to provide and of contributing to the de pendency or delinquency of children, were brought before one court. A central record system, a clinic and staff were added to the court for administration. The movement for family support of the National Parole and Probation association, the courts has continued with the National Association of Legal Aid organizations and other social agencies. In states and counties not having family courts, the pro cedure for handling divorce, desertion and dependency cases is much more complex. In Milwaukee county, Wis., an entirely separate juvenile court was established by sta tute in 1953, so that a present, jurisdiction over custody of children of divorced parents is in one court, and jurisdic tion over dependent, delin quent and neglected children is in an entirely separate court. As admitted by Milwaukee county court personnel, the court structure aggravates the handling of personal prob lem cases arising out of fam ily breakdown by setting up a conflict of jurisdiction be tween two courts." Value of Court The value of the integrated family court can best be illus trated by the court of com mon pleas, Toledo, Ohio, which has been considered a model for the country. Here, under one roof, tlsix mem ber judges have authority over all family matters. About 25 differentn types of sec tions, including problems of support, separations, custody matters, neglect and depend ency, are handled by the court. : . Attached to the court, which is approximately equiv alent to the former domestic relations court and the su preme court combined, is a staff of 89 family experts, in cluding clinical psychiatrists, marriage counselors and trained social workers. The elected judge of this court is not rotated to different courts, so he is, or becomes, a special ized official. If a family is breaking down or if children of divorce get into trouble, the judge has before him the complete family record to help him get at the truth and the best solution. . Such a court not only saves time, trouble and expense, but most of all it helps prevent mistakes on the part of courts and court workers, according to Judge Paul W. Alexander of the Toledo court. The family court has family experts to handle the social problems which are nearly al ways a factor in desertion cases- In this way the social casework agencies aren't trou bled with court cases, which would interfere with their normal daily routine. The court takes care of both the emotional and sociological problems associated with all of the desertion cases that enter its jurisdiction. The ideal socio - legal ap proach to the desertion prob- lem can be reached if the family court program can be correctly established. Reha bilitation of the deserter can be accomplished more effec tively while he is being held for the court. The deserter can be told what his running away really means to the family; the significance of his actions can be impressed on him.. The deserter as well as the deserted can be counseled. Reconciliation of the deserter with his family can also be attempted at the same time that he is being questioned. Family courts in Oregon would not only cut d&wn des ertions, but would help stem the rising; incidence of di vorce. Institution of a uniform family court system would not mean the closing down of all other social work, but if family court cases could, be completely handled by spe cialists in the field, the result ant quality of treatment would probably be much more beneficial. . MAIL TRIBUNE, M.dford, Oregon, Thursday, June 26. 1958 TA ILLINOIS VALLEY Truck Damages Station By RUTH ROUSCH Cave Junction An Oregon state division of highways truck and trailer, in attempt ing to drive through the low lane of the Redwood Highway Inspection station Friday, caused considerable damage to the overhead door at the station when the trailer tank hit the structure. The trailer also suffered considerable damage. Mr. and Mrs. Arly Win chester, newcomers to the valley from Los Angeles, are building a home on Caves Highway. The Rev. Denning and son, Timothy, are in Eugene this week, looking over the voca tional school where Timothy is enrolled for classes in aero nautics this fall and to ar range for board and room. The Cave Junction Commu nity school will have their Sunday School promotion day Sunday, June 29, according to Mrs. Marvin Cross, Sunday school superintendent. Some 50 children will re ceive certificates and merit awards during the Sunday school hours. A little program will be presented. The George Martin Jrs. have returned from a vaca tion in Washington. Mr. and Mrs. Harold Martin and children, Larry, Dwain, Bruce, Nickey and Marilyn, have moved to the valley from Grants Pass, taking resi dence in the former Earl Mor ris place. ' J - .
