Brand Proposes
Taking justices
Out of Politics
Salem (UPI) Retiring
Oregon Supreme , Court Jus
tice James T. Brand says that
newly - appointed justices
should be freed from the ne
cessity to campaign during
their orientation period on
the court. '
Justice Brand, who has an
nounced his retirement effec
tive July 1, says adoption of
the so-called "Missouri sys
tem" would help speed han
dling of the backlog of court
cases.
He said that under the sys
tern justices are appointed by
the governor for 12 yeajs and
are subject to recall at stated
intervals by popular vote.
Should Be Separated
Justice Brand said the judi
cial office should be separat
ed from partisan politics.
He cited the cases of Jus
tice William McAllister, who
was named to succeed the
late Walter Tooze, and of
Gordon Sloan who was nam
ed to succeed Justice Randall
Kester who resigned to take
another position. He said
each was compelled to spend
time and effort to conduct a
campaign for election to the
court.
Justice Brand estimated
that 19 out of 20 Oregon en
tries into the state judicial
system come first by appoint
ment, followed by election.
He said no man can be ex
pected to give up a law prac
tice and then studiously de
vote his time to writing judi
cial opinions when politicians
are out to beat him in an
election campaign.
