THE CITY OF MEDFORD DOTH ORDAIN AS FOLLOWS: SECTION 1. That, for the pur poses of this ordinance, the term "Primary Election" shall mean the General Primary Election to be held in and throughout the State of Oregon on the 16th dav of May, 1958 pursuant to ORS 249.340. SECTION 2. That there is hereby called to be held within and throughout the City of Medford, Oregon, a special election on the 16th day of May, 1958 at the same time and place as the Primary Election, for the purpose of sub mitting to the legal voters of the said city the various acts of pro posed municipal legislation here inafter set forth. The following de scribed territory is hereby an nexed to and incorcorated within, the City of Medford, Oregon, to wn: Beginning at a point on the north line of the tract de scribed on Page 363 of Volume 353 of the Deed Records of Jackson County. The boy resisted' strenuously. The teacher gave up and call ed Mr. Jones. The boy re sisted him, too, but Jones, who weighed 190 pounds, drag ged him to his office. To subdue the boy the prin cipal pushed him to the floor and held him down by placing one knee on the boy's stom ach. He sent for the boy's older sister. When she arrived, Jones was sitting on the boy's stomach. When the sister took the boy home, he complained of back pains and it was dis covered that he had suffered rather serious injuries . He went to court seeking damages from the principal. The Con necticut court pointed out that a principal or school teacher has the authority to discipline pupils when neces sary and may even do so by use of reasonable force. But in this case, Jones was unrea sonable and used too much force and was found liable to the boy. In general, the law author izes a school teacher or prin cipal to dicipline pupils. He may use corporal punishment if necessary to preserve order, decorum or morale of the school. The law does insist, however, that the punishment be reasonable under the cir cumstances. The head of the family also becomes involved in many cases of discipline. The hus band or father, by early com mon law, had a great deal of authority to discipline mem bers of his family. In many places, before laws were pass ed recognizing the rights of married women, a husband could chastise his wife and be acting "reasonably" if he used a stick "no larger than his thumb." Today he has no right to discipline his wife or his servants by use of force. He may use corporal punish ment on his children so long as the force is not excessive. Throughout history a ship's captain has had authority to discipline the members of his crew and his passengers. Prac tically all courts agree that a captain needs such authority. In an early case the cook The aboard a schooner refused twice to take the captain a cup of tea. The captain then beat him on the head with a "belaying-pin" causing serious injuries. In an action for dam ages the court held that the captain used unreasonable and unnecessary force and was liable to the cook. In another case the court felt the captain used excessive punishment when he had a passenger put in "irons" for referring to the captain as the landlord of a floating hotel.
