That a special election will be held in the Medford Irrigation Dist rict, Jackson County, Oregoni on Tuesday, the 14th day of January, 1958, for the purpose of determining whether the board of directors of the district shall be authorized for and on behalf of the district to enter into a repayment contract with the United States of America, for the following general purposes: To provide for a supplemental water supply for the irrigation of the lands of the district and lands to be included in the district, together with the improvement, betterment and ex tension of the facilities of the dist rict. To obligate the district to repav to the United States, without interest, the district's proportionate share of the cost of the construction necessary to make said supplemental water sup ply available to the district and the cost of the betterment, extension and improvement of the facilities of the district in an amount not exceeding Nine Hundred Sixty-Four Thousand Dollars ($964,000,001. this amount in cluding an estimated cost of Three Hundred Sixty-One Thousand Dollars (361,000.00) for the enlargement and improvement of the district's canal and lateral system and the reconstruc tion of the Bear Creek Diversion Dam, the maximum amount to be re duced by the difference, if any, be tween the estimated cost of the en largement and improvement of the district's canal and lateral system and the reconstruction of the Bear Creek Diversion Dam and the actual cost of the work covered by that estimate. Said obligation shall be repaid to the United States in annual installments scheduled as follows: (1) During the period from the year of the first installment through those years in which the district is obli gated to pay 'annually on account of its presently existing bonded obliga tions, including interest, an amount of not less than Nineteen Thousand Dollars ($19,000.00), or through De cember 31st, 1969, whichever period is shorter, the annual installment shall be Four Hundred Fifty Dollars ($450,001 (2) Thereafter, during the period from the year following the last year a payment is due under subdivision (1) hereof through those years in which the district is obligated to pay its rehabilitation and betterment charge obligation under the contract between the United States and the district, dated August 1, 1955, the an nual installment shall be Two Thou sand Two Hundred Eighty-Four and 50100 Dollars ($2,284.50). (3) Thereafter, the annual install ments shall be the amount determined annually by dividing the then unpaid construction charge obligation as of December 31st of the prior year by the number of years obtained by sub tracting the number of installments theretofore due under this paragraph from sixty (60) years, except that the last installment shall not exceed the amount necessary to pay the full con struction charge obligation. Said re payment shall be without interest and the first of said annual installments shall be for the year following the year in which the Secretary of the United States Department of Interior notified the district that the work under this contract has been substan tially completed, and shall be due and payable on December 31st of the year following, said year in which the said Secretary so notifies the district. Each subsequent annual installment shall be due and payable each Decem ber 31st thereafter until the total con struction charge obligation is paid in full. To make the contract obligation the general obligation of the district; to provide for the assumption of control of the district's works by the United States if the district defaults, and for the inspection, care, repair and pro tection of the district's works; and to contract with respect to matters in performance of the provisions of the Federal Reclamation Laws and all acts amendatory thereof or supple mentary thereto. That a form of contract substan tially incorporating the hereinabove referred to provisions is available for inspection at the office of the district at 1310 Barnett Road, Medford, Jack son County, Oregon. 2. That the maximum amount of money proposed to be payable to the United States by the district for said construction, repair and betterment purposes is Nine Hundred Sixty-Four Thousand Dollars (964,000.00). 3.
