Convict-author Caryl Chessman 13 "confident'' he will win a new trial as the result of a U. S. S'lprerne Court decision order ing a new hearing in his case Chessman said yesterday he believes the ruling opns the way to ''what I wanted in the first place a new trial." "After nine years. I'm right hack where I started." said the 36-year-old convict. "Ironically enough, that's progress for me." Hearing Ordered In a 5-3 decision, the Supreme Court set aside his death sen tence and ordered that a new hearing be given him in the Cal ifornia courts to determine the accuracy of the transcript of his trial. Persons close to the case believe he will now go before Superior Judge Charles Fricke In Los Angeles. "You can't be this close to the gas chamber for nine years without getting a little pessimist ic once in a while," Chessman said. "But I'm confident the hearings will bring about a new trial." A Los Angeles Superior Court jury found Chessman guilty in 1943 of 17 counts of rape, rob bery, kidnaping, sexual perver sion and car theft. He received the death sen tence for twice violating the state's "Little Lindbergh Law" kidnaping with bodily harm. He also received two life terms without possibility of parole, and sentences totaling 99 years on the rest of his convictions. Two days after his trial end ed, the court reporter who took the testimony died Another re porter related by marriage to the prosecutor took over I the job of transcribing the notes. i In his long battle to over throw his conviction. Chessman i has claimed that the courts have upheld his death sentence on the basis of this "'prejudicially incomplete and inaccurate" transcript. The Supreme Court said it did not necessarily agree that the transcript was all that Chessman said it was, but it be- ! lieved he "never had his day in court" on the matter. Pms-Winner! Two of the most prominent holdovers were Christian Pineau and Robert Lacoste, both Social- j ists. Pineau is minister of for j eign affairs and Lacoste is min ister-resident of Algeria. Dropped from the Cabinet was veteran Socialist Paul Ra madier, finance minister in the Mollct government whose call for higher taxes resulted in Mol let's defeat. Felix Gaillard. a radical Socialist, succeeded Ra-madier.
