Ore gon: and directing the Recorder to enter a statement thereof in the docket of City Liens and publish a notice thereof as required by the Charter. THE CITY OF MEDFORD DOTH ORDAIN AS FOLLOWS: Section 1. WHEREAS, the City Council did heretofore by Ordinance declare its intention to construct paving, curbs and driveways on Modoc Avenue, from East Main Street to Woodlawn Drive, in the City of Med ford. Oregon; and to assess the cost thereof upon each lot or part thereof adjacent to and benefited by such improvement its proportionate share of the cost of said improvement, and did fix the time and place for hear ing protests against the construction of said improvement, and the assess ment of the cost thereof, as afore said, and WHEREAS said Ordinance was duly posted and published as required by the Charter of the City; and WHEREAS a meeting of the Council was held at the time and place fixed in said Ordinance for the purpose of considering any such protests, but no protests were at such time, or at any time, made to, or received by the Council to the construction of said improvement, or the assessing of the cost thereof, as aforesaid, and said Council has considered the mat ter and deeming that said construc tion of said improvement was and is of material benefit to said City, and that all the property to be assessed therefor will be benefited thereby to the extent of the probable amount of the respective assessments to be levied against said property, did order the construction of said improvement; and WHEREAS, the cost of said im provement has been and hereby is de termined to be the sum of SIS. 176.99.
