Thornton says the State Board of Education has been granted power to make rules and regulations establish ing standards for the state's pub lic schools. In an opinion requested by the board, Thornton said the law granting the board this power is constitutional. However, Thornton added "it is the province of a court and not this office to say authori tatively whether or not a law enacted by the legislative assem bly transgresses the constitu tion." The attorney general also held that statutes require that free textbooks be provided to qual ified pupils attending standard elementary and secondary schools.
