Ore gon: and directing the Recorder to enter a statement thereof in the docket of City Liens and publish a notice thereof as required by the Charter. THE CITY OF MEDFORD DOTH ORDAIN AS FOLLOWS: Section 1. WHEREAS, the City Council did heretofore by Ordinance declare its intention to construct curbs and gutters, driveways, and asphaltic concrete pavement on Fairmount Street from Summit Avenue to East end of street, in the City of Medford. Oregon; and to assess the cost there of upon each lot or part thereof ad jacent to the benefited by such im provement its proportionate share of the cost of said improvement, and did fix the time and place for hearing protests against the construction of said improvement, and the assessment of the cost thereof, as aforesaid; and WHEREAS said Ordinance was duly posted and published as required by the Charter of the City; and WHEREAS a meeting of the Council was held at the time and place fixed in said Ordinance for the purpose of considering any such protests, but no protests were at such time, or at any time, made to. or received by the Council to the construction of said im provement, or the assessing of the cost thereof, as aforesaid, and said Council has considered the matter and deem ing that said construction of said improvement was and is of material henefit to said City, and that all the property to be assessed therefor will be benefited thereby to the extent of the probable amount of the re spective assessments to be levied against said property, did order the construction of said improvement; and WHEREAS, the cost of said improve ment has been and hereby is deter mined to be the sum of $9.108 20, NOW THEREFORE, it is hereby de termined that the proportionate share of the cost of construction of said improvement, on each parcel of prop erty adjacent to said improvement and benefited thereby is the amount set opposite the description of each piece or parcel of land below, and that each piece or parcel of land is benefited by the construction of said improvement, to the full extent of the amount so set opposite such piece or parcel and that the respective amounts represent the proportional benefits of said improvement to said respective parcels of property, and the Council does hereby declare that each of the parcels of property described below is hereby assessed the amount set opposite each respective description, tor the cost of construction of said improvement.
