October !, 1358 e9'tOS'98 SUCCEEDING father, Anas tasio Somoza, slain by an assassin, Luis Somoza. 34. becomes president of Nica ragua. , ( International) Klamath Judge Favors Stale in Anderson Writ Klamath Falls (U P; Klam ath County Circuit Judge David R Vandenbcrg yesterday ruled in favor of the State of Oregon in its demurrer to a writ of habeas corpus filed by convicted slayer James Quinton Anderson. "The matter of whether the stste has jurisdiction over crimes on the Klamath Indian reserva tion." Judge Vandonbcrg said, "has been most talked off, but tl-.e important point and the one this court has considered is whether the Congress of the United States can delegate powers to tho state. Excluded by Treaty A treaty between the United States and the Klamath Indians ratified in 1370 excluded In dians from state jurisdiction. Judge Vandenberg ruled that Public Law 230 whi-h is part of Public Law 587, the Klamath reservation termination act. re leased jurisdiction from the fed eral government to the state government. Public Law 2H0 by implication repealed all federal laws or treaties. Judge Vanden berg said the question of whether Congress has power to delegate jurisdiction is one which "I feel I am not in a posi tion to pass on." Ruling To Be Appealed Leonard Waterman of Burns, one of Anderson's attorneys, said the ruling would be appeal ed to the Oregon Supreme Court. Anderson was convicted in a Harney county Circuit Court in 1955 of the slaying of Richard David Miller, Klamath reserva tion show horse breeder. Sub sequently the Oregon Supreme Court upheld the conviction and life sentence of Anderson. Israel Revenge For Deaths Feared Jerusalem (Israeli Sector) (U.R) The Middle East feared today Israelis will organize a new punitive expedition to avenge the Arab slaying of five Israeli civilians in an ambush near the Jordan border. An American engineer escaped death in the attacks. In recent weeks Israel has re taliated against such alleged Arab attacks with savage mili tary sorties that have taken the lives of at least 48 Jordanians. And just three days ago Israel withdrew from the United Na tions Mixed Armistice Commis sion which investigates such border incidents, charging that the investigators placed too much of the blame on Isreal. Israeli officials said Arab vaders opened machinegun fire Thursday on two vehicles near Sodom, at the southern end of the Dead Sea, and nine miles from Jordan. All four occupants of a truck were killed and one passenger in an automobile was cut down when he tried to flee. An American engineer who was riding in the bullet-riddled car escaped injury but had to be treated for shock. He was identi fied only by his last name. Smith. i PLEASURE AND PAIN North Haven, Me.
