WHEREAS the City of Medford has hereto! ore caused a water main to be laid in Murphy Road adjacent to cer tain real property in the City of Med ford fronting on Murphy Road and the Council being of the opinion that said water main may be used by the property fronting on that portion oi said main as laid in Murphy Road from a point 478 feet Nortn of Bar nett Road to Walden Place, and WHEREAS said water main has not. ae yet. been paid for and it appearing to the Council that the use of saio water main as a lateral water main by said property last above mentioned will not materially interfere with the use thereof for the purpose for which it was originally laid, now therefore. BE IT RESOLVED BY THE COUN CIL OF THE CITY OF MEDFORD, OREGON Section 1. That it is the opinion of Hie Council that that part of the aforementioned water main laid in Murphy Road adjacent to certain real Eierty in the City of Medford front on Murphy Road described as fol ic to-wit: As laid in Murphy Road from a point 478 feet North of Barnett Road ftp Walden Place. May be used by the property fronting thereon as a lateral water main with- ! out materially interfering with the j use thereof for the purpose of a water ! main, the purpose for which it was 1 originally laid, and the Council pro poses to permit the owners of adjacent ' property to use the same for lateral ' purposes as aforesaid. Section 2. It is the intention of the i Council to assess the property fronting 1 on Murphy Road wherein said water main Is laid as hereinbefore last des- ; eribed its proportionate share of so 1 much of the cost thereof as equals the special benefit which will result to said property from the use of said 1 water main as a lateral water main of i such size as would be required to j supply the property fronting on said Murphy Roed in case said water main was not so used and the Council has and does hereby determine that the ! sum of $3.25 per front foot is the i amount of such special benefit and the proportionate cost of such a : lateral water main to such property J as aforesaid and intends to assess i said amount against such adjacent I property on account thereof. Airplane Found In Wallowa Area; One Dead, One Hurt La Grande (U.PJ A ground party of smoke jumpers reached the wreckage of a light plane in the Wallowa mountains early to day and reported to the forest service that Vernon Enger, 34, Vancouver, Wash., was alive but his wife was dead. The couple had been missing since Sunday when they took off from Red's Horse Ranch in the Wallowa mountains about 22 miles east of here. Radio reports from the ground party said Enger was a stretcher case. He was being taken to the ranch, about four mfles front the crash scene where a plane waited to fly him to a hospital here. The body also was being brought out. The forest service said Enger apparently had been hurt too badly to seek help. The plane- was sighted from the air late yesterday in a deep canyon west of the ranch andl aerial observers thought they saw someone on a blanket. Eight smoke-jumpers were dropped in the area yesterday evening and battled thundershowers and rug ged terrain to reach the-plane. The plane was down near the Little Minam river. Its wings were damaged but the fuselage appeared intact from the air. Henry Voetberg, La Grande pkot, reported seeing a victim on the blanket waving a small piece of cloth. (U.R) Marilyn Bell, an 18-year-old school girl who earned $20,000 by failing to swim the strait of Juan de Fuca, won $10,000 last night by swimming the 18.3-mile, treach erous stretch of water. The blonde marathon swim mer made the swim in 10 hours and 39 minutes breaking the rec ord set by a man. Miss Bell, who already has swam across the English channel and Lake On tario, was the fifth person to cross the Juan de Fuca. The strait has resisted 62 other challengers. The old record was aet by Bert Thomas of Tacoma, Wash., in 11:17 last July. In Miss Bell's first attempt to cross the strait this year she wa offered $30,000 it ah luooMded and $20,000 if sh felled.
