Oregon ORDINANCE NO. fiJSJ AN ORDINANCE declaring the assessment on property benefited by the use of a water main on Murphy Road from Barnett Road to a point 473 feet North as a lateral water main, and directing the Recorder to enter a statement thereof in the Docket of City Liens and publish a notice thereof as required by the Charter. THE CITY OF MEDFORD DOTH ORDAIN AS FOLLOWS Section 1 . Whereas the Citv of Medford did heretofore cause to be constructed and laid a water main in Murphv Road from Barnett Road to a point 478 feet North and ad lacent to renain real property m the City of Medford trontine on Murphy Road and the com of said watpr main has not been paid and the Council is of the opinion that said water mam mav be used by the propertv fronting on said Murphy Road wherein said water ma-n has heen laid a a lateral water mam without materially inter fering with the use thereof for the purpose for which it was originally laid and: WHEREAS the Council did. after sid water mam was laid, declare by resolution, it.s intention to assess the propertv fronting on said Murphy Road within which said water main as laid and which it proposed to permit the owners of adjacent prop ertv to use tor lateral water main purposes and did. m said resolution. designate the amount per tront toot which it proposed to assess against said ariiacent property, and; WHEREAS said resolution was duly- posted and published as required by the Charter, and whereas a meeting of the Council was held at the time and place fixed in said resolution for t he purpose of considering any pro tests against such assessment, hut no protests were made at such time or at anv time thereto and the Council having considered the matter and deeming that the use of said w ater main for lateral purposes, as afore said, is of material benefit to the said City and that all of the property tn be assessed therefor will be bene fited thereby to the amount of the assessment herein levied against the same, and; WHEREAS the Council has deter mined that the sum of -2 .25 per front foot is n proper and reasonable amount to be assessed against the prcpertv fronting upon the road with in which said water mam was laid. now therefore each parcel t prop- i erty hereinafter set iorth and de- i scribed is hereby found to be bene- j fited bv the use of said water main as a lateral wateT main and each thereof is hereby assessed the amount set opposite each respective descrip tion tor the use of said water main lor la'era! purposes, as aforesaid.
