WHEREAS the City of Medford has heretofore caused a water main in the City of Medford to be laid on Biddle Road from Jackson Street to a point 651 feet North, and the Council being of the opinion that said water main may be used by the property fronting on that portion of said main on Biddle Road from Jackson Street to a point 651 feet North, in the City of Medford, Oregon, and WHEREAS, said water main has not, as yet, been paid for and it appearing to the Council that the use of said water main as a lateral water main by said property last above mentioned wrill not materially interfere with the use thereof for the purpose for which it was originally laid, now therefore, BE IT RESOLVED BY THE COUN CIL OF THE CITY OF MEDFORD, OREGON Section 1. That it is the opinion of the Council that that part of the aforementioned water main laid in the City of Medford described as follows, to-wit: As laid on Biddle Road from Jack son Street to a point 651 feet North in the City of Medford. Oregon. May be used by the property front ing thereon as a lateral water main without materially interferring with the use tnereof for the purpose of a water main, the purpose for which it was originally laid, and the Council proposes to permit the owners of adja cent property to use the same for lateral purposes as aforesaid. Section 2. It is the Intention of the Council to assess the property front ing on the streets wherein said water main is laid as hereinbefore last de scribed its proportionate share of so much of the cost thereof as equals the special benefit which will result to said property from the use of said water main as a lateral water main of such size as would be required to supply the property fronting on said streets in case said water main was not so used and the Council has and does hereb'y determine that the sum of S2.25 per front foot is the amount of such special benefit and the pro portionate cost of such a lateral water main to such property as aforesaid and intends to assess said amount against such adjacent property on ac count thereof. Section 3. The Council will meet at the hour of 7:30 o'clock P.M., at the Council Chamber in the City Hall on the 1st day of May, 1936. at which time and place all protests of said assessment, as hereinbefore provided for. will be heard. Section 4. The Recorder Is hereby directed to serve notice hereof upon the property owners aforesaid by pub lishing this resolution 3 times in a newspaper published and of general circulation in said City and by posting the same in 5 public places in said City: said publication and said posting to be not less than 10 days before the date of said meeting.
