That there is due and owing and whollv unpaid from the Defendants on that certain Agreement of Sale made and entered into between the Plaintiffs fas vendors therein; and Roy C. Thigpin and Evelyn P. Thiepin. husband and wife, of defendants (as purchasers therein) under date the 17i day of July. 1951. wherein the purchasers therein agreed to pur chase (J)-om the vendors therein the following described real property sit uate in Jackson County, Oregon, to- W1': . . j. OFrom the northeast corner of Lot 1 Eighteen (13) of the MIDWAY J O TRACT in Township 38 South, Range 1 West of the Willamette Meridian in Jackson County, Oregon, according to the official plat thereof, now of record, run thence North 895Q' West along the north line of said tract 1000.0 feet, and thence South 263.8 feet V the true point of beginning: Sence North 8950' West 852.9 feet to the easterly line of the right-of-way of the Southern Pa cific Company: thence along said easterly line. South 4303' East 4412 feet: thence South 8952' East 551.7 feet; thence North 322.5" feet to the true point of beginning, the full principal sum of $9,775.00, to gether with interest thereon at the rate of 5 per annum from and after the 17th day of July, 1954. until paid, and together with the sum of S600.00 as attorneys fees for the prosecution .of this suit and together with Plain tiffs' costs and disbursements herein to be taxed. 2. That all the right, title and In terest of the Defendants herein and all persons claiming by. through or under them, or any of them, in and to the above described real property agreed to be sold under said Agree ment of Sale, as aforesaid, be fore closed and wholly terminated, save onlv the right of redemption as herein stated. 3. That the Defendants max re deem said property within thirty (30) days from the date of the entry of uch Decree, or within such further time as this Court may find and de termine to be just and equitable, by paying to the Clerk of this Court for the use of Plaintiffs the amount owing and unpaid from the Defendants, as aforesaid, together with interest there- e w from that date of such Decree to the time of payment. 4. That if the Defendants shall, fail to pay said amounts as aforesaid within said period of time, as afore said, the Plaintiffs, without further notice to the Defendants, upon Motion therefor, shall have the further De cree of this Court decreeing that all the right, title and interest of the De fendants, and all persons claiming by. through or under them, or any of them, in and to said property, or any part thereof, be forever terminated and that the Defendants be forever enjoined from claiming any right, title estate, lien or interest in or to said property, or any part thereof; that upon a Decree of Foreclosure being entered in favor of the Plaintiffs here in that Plaintiffs be granted posses sion to the above described real prop erty.
