The Japanese trial of four American soldiers charged with attacking Japanese police was recessed for two weeks Saturday to en able the court to study a defense claim that the trial was uncon stitutional. Defense Attorney Frank Scol inos demanded the case be thrown out of court. He said the U.S.-Japan agreement that gave Japan jurisdiction over U. S. servicemen was not ratified by the U. S. Senate and therefore was unconstitutional both in the United States and Japan. The four soldiers on trial are Pfc. Alan May, 21, Cleveland; Corp. Walter R. McKenzie, 21, Detroit; Pfc. Kenneth J. Rey nolds, 22, McGee, Ark., and Sp3 Jessie Nortyke, 22, Min neapolis, Kan. They are accused of brawling with police of this town, about 60 miles northwest of Tokyo, last Sept. 4.
