(Anders Photo) Convicted Reds Tell of Plan To Appeal Verdict Denver iUR) Seven lower echelon Communists convicted Wednesday night of conspiring to advocate the violent over throw of the United States gov ernment' served notice today they, would appeal their convic tions while they remained free on bond. District Judge Jean S. Breiten- stein gave 11 court-appOinJed at torneys for the defense until June 9 to file motions and set June 15 as the day the motions would be argued. Appeal Notice Given Arthur Bary, 43, one of the defendants who was described by the. FBI- as a Communist underground leader assigned to find out how FBI agents were tracking down Reds, said min utes after the jury returned its verdict "we intend to appeal." The verdict was returned by the jury of seven men and five women after eight hours and 20 minutes of deliberation. The jurors had listened to a large number of government witnesses and extended arguments since the trial started March 23. Face Five Years The defendants,' including Bary's 29-year-old wife, Anna, face a maximum of five years in prison and $10,000 fines If their appeals fail. The five other defendants were Harold "Zepelin, Lewis Johnson of Utah, Joseph William Scherrer and Mai Scherrer, his wife ,of Pueblo, Colo., and Pa tricia Blau of Los Angeles. The government had stated in its Smith Act indictments the seven plotted the destruction of the government by force at meetings in Colorado over a period of years. Bryson Attorneys Request Hew Trial San Francisco (U.R) At torneys for former left wing maritime labor leader Hugh Bry ron, who have asked for a new trial for the convicted perjurer, said today they were confident he "would , not serve a day in jail." Bryson, . 40-year-old former leader of the now-defunct Na tional Union of Marine Cooks & Stewards, was convicted by a federal court jury yesterday for falsely swearing in a Taft-Hartley affidavit, that he was not "affiliated with" the commu nist party. The iurv of seven women and five men found Bryson innocent of a second count charging that he lied when he swore he was not an actual member, of the party. The jury reached the verdict in the court of Federal Judge William C. Mathes after 10 hours of deliberation which started early Tuesday afternoon. The judge will hear arguments for a new trial on June 8. Phoenix Firemen Plan To Offer Inspections Phonix The Phoenix volun teer fire department will con duct a home fire prevention pro gram beginning June 1, Leo Fur ry, fire chief has announced. The firemen will make a house-to-house canvass to point out to householders common fire hazards which exist in most homes, and how fire can be pre vented by removing them. The firemen will not be looking for violations and will be there merely to be helpful to home owners or occupants. Three Mining Claims Recorded in County Three mining claims were filed in the Jackson county recorder s office Tuesday. William A. Reese Sr., and Dr. R. L. Falk filed a claim for cm nabar and other valuable min erals in the Evans Meadows mining district. The claims are known as Kathleen. No. 1 ana Kathleen No. 2.
