offensive" no matter how much
it is "watered down."
The statement came Friday
night from Glenn L. Archer, executive-director
of Protestants
and other .Americans United for
Separation of Church and State.
On Bargaining Table
Archer declared that negotia
tions on the subject have put
the most sacred rights of, Amer
ican citizens" on "the bargain
ing table." Adoption of the plan,
he added, would put "ah irradi
cable stain of dishonor on the
record of our nation."

(Mickey) Jelke, 24, Saturday
faced a new vice trial on charges
of procuring and supply high
priced call-girls for cafe society.
The heir to a $3,000,000 oleo
margarine fortune won a new
trial Friday when the Court of
Appeals in Albany, the state's
highest court, ruled 4-2 that
Jelke was denied a fair trial
when General Sessions Judge
Francis L. Valente barred the
press and public from the court
room. - D A Supports Action
Disk Atty. Frank S. Hogan,
who supported Valente's actions,
said he would begin prepara
tions i'or the new trial im
mediately. Friday night three women, in
cluding the prosecution's star
witness, model Pat Ward, and
a "new" mystery witness were
arrested as material witnesses
for the new trial.
In February, 1953 Jelke was
convicted on two counts of com
pulsory prostitution - ,. enticing
Miss Ward, then 18, into prosti
tution, and attempting to per
suade Marguerite Cordova,
nightclub hat-check girl, to be
come a prostitute and was sen
tenced to three to six years in
prison.

He has been free on $50,000
bond pending the appeal.
Miss Cordova, 26, was one of
the witnesses arrested Friday
night. She was held in $2,500
bail. The new witness, also held
in $2,500 bail, was identi-ied
as Peggy Sands, 25. Her connec
tion with the case was not re

ley Lyons of Rochester did not
seek reelection this year and his
term on the governor's council
expires in January. He really
got himself tabbed "lame duck"
when he came to a recent State
House meeting on crutches after
breaking a leg.

leader of the Anti-McCarthy "Joe
Must Go" club will probably ap
peal a judge's ruling that the
organization violated .state law,
Leroy Gore, a Sauk City, Wis.,
editor and founder of the club,
said he would return from an
Iowa visit immediately and study
a possible appeal.
Fined $4,200
The organization, which con
ducted an unsuccessful attempt
to recall Sen. Joseph R. Mc
Carthy early last year, was
found guilty Friday on 21 counts
and was fined $4,200

said the club violated a state
law that forbids corporations
from contributing money for pr
litical purposes.
Dist. Atty. Harlan Kelley, who

motions to dismiss indictments
against Woodrow Wilson At-
wood and Stephen Gilbert Crip-
pen, two Medford salesmen, on
charges of illegal possession of
gold..
Chief U. S. District Judge
Claude McCollocn held in an
opinion that there is no doubt
of the power of the government
to forbid possession of gold bul
lion except on license. The pow
er is derived as part of its mone
tary program, he said.
Had $5,000 in Gold
The two men were arrested
several weeks ago in a Port
land hotel in possession of a
suitcase containing $5,000 worth
of gold bricks.
Defense lawyers argued that
the act was unconstitutional and
was passed as a war emergency
and that it ceased to be effective
after the war ended." The fed'
eral attorney asserted, however,
that congress had recognized the
effectiveness of the law and had
adopted an amendment in 1941
Judge McColloch concluded
his brief opinion that the ques
tion involved was a "political"
one and not constitutional.

John Jacob Astor III Saturday
sought annulment or divorce
from his third wife' on grounds
she "shoved" him into marriage
knowing his Mexican divorce
from wife number two was in
valid. In his counter suit filed in
Dade Circuit Court Friday, Astor
claimed jthat Mrs. Dolores Dolly
Fullman of Miami Beach was not
his legal wife and therefore not
entitled to any of his money.
Resistance Broken
Astor charged that she "shoved
him" into marriage knowing that
his Mexican divorce from the
second Mrs. Astor was not legal.
He was married to Mrs. Fullman
in Arlington, Va., Aug. 6, 1954,
after his "resistance was
broken," he said.
The charges were contained
in his answer to her suit for an
nulment. Her suit was filed last
Nov. 22 because of something
"so intimate in nature" she
didn't want to tell about it. ,
Smacks of Blackmail
Astor's suit described the al
legations against him as "scurri
lous charges and innuendoes,
smacking of a form of blackmail
that is becoming all to prevalent
in this country.
He said the charges were "not
only false but diabolically made
in the furtherance of a vicious
entrapment scheme concocted
before marriage for the purpose
of mulcting him of his money."
Before their marriage she
would not even let him kiss her,
he said.
Motor Carriers in
Oregon Report Big
Revenue Increases
Salem U.R) Motor carriers
operating in Oregon had total
operating revenues of $177,408,
600 in the nine months ended
last Sept. 30, State Public Utili
ties Commissioner Charles H
Heltzel said Saturday,
i Operating, maintenance and
other expenses totaled $166,
830,143, leaving net revenues for
the nine-months period of $10,
578,457. ,
Total net revenues for all the
truck lines in the first nine
months of 1954 were $704,848
above the net operating rev
enues for the first three quar
ters of the year previous.
- The same' audit showed that
some of the big truck operators
who do only intra-state business
are paying themselves quite
handsome salaries in addition to
the profits gained from their
operations.
The head of one truck line,
the audit showed, drew an an
nual salary of $39,000. Also
listed in the audit of this line
is the added sum of $4395 for
personal expenses, not detailed.
The president of another
truck line drew $25,2.00 annual
salary and his son drew $30,000.
Small Lines Struggling
At the other extreme, opera
tors of small truck lines were
struggling to keep in business,
some drawing little or no salary
and faced with operating ex
penses exceeding operating in
come. . .
But between the two extremes
were many truck lines whose
heads were drawing between
$7200 and $12,000 a year in
salary, plus any profits accru
ing from the business.
The average track operator
had a 5.49 per cent earning
after all expenses had been met.

foot-per-second flow, carve out

Damage 'Doubted -'
A. E. Perry, watermaster for
the Bureau of Reclamation, said
he doubted the overflow would
do much damage, due to the
porous nature of the soil and the
protection of grass and timber.
Repair work on the basin is
expected to be completed by
Jan. 15, permitting use of reg
ular overflow channels.

to "retire" Saturday because he
made an illegal left turn. ,
Peter J. Frank's fling at med
icine came to an abrupt end
Friday when patrolman John O'
Connor stopped him for making
an illegal left turn in his auto
mobile. 3came Suspicious
O'Connor became suspicious
when Frank, . 29, was hesitant
about showing credentials which
identified him as "Dr. Peter J.
Frank."
A search cf the car turned up
a .32 caliber . automatic, and
O'Connor arrested Frank.
The "doctor" insisted at first
that he had studied at North

school. But after several hours
hours of questioning he admitted
least 340 years old. In 1611 A.D.,

CENSUS INCREASES
Washington - (U.R) -There
were 163,900,000 Americans on
hand to greet the new year, the
Census Bureau estimated. This
is an increase of 2,700,000 over,
a year ago. The figures include
members of the armed forces
abroad.
