TWO MEDFORD (OREGON) MAIL TRIBUNE Sheppard Hears State's Attorney Tell of Details of Wife's Death Cleveland U.R) Dr. Sam H. Sheppard sat with eyes closed and face deathly pale today as the state's attorney described how his wife was beaten to death and pointed the finger of accusation to him as the murderer. The 30-year-old brain sur geon's mouth trembled and he wiped a hand across his closed eyelids as assistant prosecutor John J. Mahon calmly recited to a jury of seven men and five women the death scene last July 4. Opening Statement The state was making its opening statement in its effort to send "Dr. Sam" to the elec tric chair. Garmone in his opening statement said the defense will prove "that the last four months of the married life of Marilyn Sheppard and Dr. Sheppard were the happiest." Contract To Buy Home Garmone said the doctor had entered into a contract to buy his home and had placed it in his wife's name. He said Sheppard took out 820,000 in life insur ance on himself and made his wiie and young son bene ficiaries. "They talk about the illicit af fairs Sam is supposed to have had," Garmone said. "When he received his salary checks, he endorsed them, turned them over to Marilyn and she went to the bank, took out what was needed to operate the home, and put the balance in Sam's ac count. "Does that add up to murder?" Brutally Beaten Mahori, 63, a widower who has a record of 100 murder con victions in 22 years as a prose cutor, leaned back, half sitting, as he spoke softly to the jury. Voice Raised Once Mahon spoke for 65 minutes. He raised his voice only once. That was when he told the jury that Sheppard and his wife had quarreled over his "activities with other women." The prosecutor told how Sheppard last March had "lived with Susan Hayes" for several days at an osteopath friend's home in California. Miss Hayes, 24, is a saucy-faced, red-haired laboratory technician who has admited intimacies with the handsome, athletic doctor. Ed Geary Eyes House Speakership Portland 4U.R) State Rep. Ed Geary of Klamath Falls last night said he is nearly assured of the speakership Sf Oregon's 1955 state legislature. ' Geary made his statement on the basis of Rep. David Baum's defeat in Tuesday's general elec tion. Baum, who claimed he had pledges enough to insure his election as speaker, was defeated by Democrat Harry L. Wells, also of La Grande. ; Geary said he had received more than 30 telephone committ ments yesterday supporting him for the speakership. Thirty-five Republicans and 25 Democrats were elected to the House in the election Tues day, making it the most even session in years. The Republicans outnumbered the Democrats 49 11 in the last session. Canadian Chairman Of Motor Association San Francisco (U.R) Some 70 delegates, representing 11 western states, closed the 27th annual Western Conference of the American Automobile As sociation Motor clubs yesterday with the election of officers. F. Walker Blake, Edmonton, Canada, was elected general chairman. Other officers chosen were J. C. Grey, Seattle, vice chairman; Dave C. Guilbert, Spokane, secretary; and Phil Townsend Hanna, Los Angeles, recording secretary. The couple is spurning movie town as a home base and will live in the East. Jean will re turn to the cinema capital only once or twice a year if her studio has a role for her. "If they don't, I won't work because I'd never work at an other studio," she shrugged. Not Retiring But Im not retiring from pictures," she insisted. "I like being an actress. I just don't want to do one picture after another. By cutting down I don't feel I'm giving up any- Oregon Gets Funds From National Forests .- Washington (U.R) Forty states and two U. S. territories have been given $16,393,583 from National Forest receipts for the fiscal year ending last June 30, the Agriculture Depart ment said today. ... Under federal law, each state and territory collects 25 per cent of the income from Na tional Forest lands within its boundaries. The payments to states, earmarked for public schools and roads in counties in which the forest lands are locat ed, are made to replace local real estate taxes. National Forest receipts come from the sale of timber, grazing fees and other forest uses. Pay ments to states this year ranged from $97.49 for North Dakota to $4,988,206 to ' Oregon. Other large payments included $2, 836,437 to Washington and $2, 537,323 to California. Heils Canyon Brief Deadline Extended Washington U,R) Hear ing examiner William J. Costello today extended until Nov. 24 the deadline for initial briefs in the controversial Hells Canyon case before the Federal Power Commission. Costello said he extended the deadline from Nov. 10 at the re quest of Mrs. Evelyn N. Cooper, attorney for the National Hells Canyon Association. She re quested the extension because of need of additional time to write her brief. The Idaho Power Co., which seeks an FPC license to build three low dams in Hells Canyon on the Snake river on the Idaho Oregon border, opposed the ex tension. Costello did not disturb the times for submission of reply briefs, Jan. 10 and an. 31. Record 45,000,000 Vote Believed Cast ' Washington (U.R) Unof ficial estimates indicated today that about 45,000,000 Americans voted in Tuesday's congressional election, a record number for non-presidential year balloting. The previous record number of votes cast in an off-year elec tion was 40,700,000 in 1950. The United Press estimate of a' 45,000,000 vote was based on a projection of the vote in states which accounted for more than half of the votes cast in 1952. " Off-year voting usually is lighter than balloting in presi dential years. In 1952 a record number of 61,552,000 voters went to the polls. An average railway passeng er's journey in the U.S. is about 72 miles, according to current tabulations. ; . . The standard leading lady in Fox films has been an enigma in the land of glamour girls. She usually kept to herself and sel dom mingled with filmsters. "I guess a lot of people were surprised at my wedding," she laughed. Jean admitted the story of her romance sounds like a script from a Fox production. They never were introduced but met by chance in an airport in Rome 15 months ago. She was return ing to Hollywood after working in "Three Coins in a Fountain" and the North Carolina oil man was on vacation. Luggage Mixup "There was a mixup in the luggage and we got to talking," she said. "He flew to Hollywood three weeks later on business and we dated." After her wedding, Jean took a leave of absence to stay in Washington with her husband. She returned to filmtown to star in "A Man Called Peter" because "I felt I owed the studio a pic ture." She enjoyed Washington, she added, because she lived there. "It is a very sophisticated city," she said. "A motion pic ture actress doesn't make a very big dent when you consider the much bigger celebrities there." Jean thinks her ""secret" ro mance 'proves a film queen can have privacy in Hollywood. "So many people scream you can't," she said. "But I even ordered 800 wedding announce ments at a department store be fore the wedding and the word never got out. My best friends helped me get ready and I asked them not to say anything. We wanted a quiet wedding." Navy Halts Search For Plane Survivors New York (U.R) The Navy has abandoned the search for survivors from a transport plane that crashed in the Atlantic ocean with 42 persons aboard. Vice Adm. Laurance T. Du Bose, commander of the Eastern Sea frontier, said the search for the missing Super-Constellation was being called off "due to ex treme weather conditions." The plane took off from Pa tuxent, Md., for the Azores and Africa last Sunday. It was last heard from 90 minutes later when it was approximately 480 miles at sea. Jack Edward Nelson, 18, of Clackamas suffered numerous cuts and deep shock as the re sult of the collision with the Holm car. His condition was not considered serious. Aubrey Crawford, Milwaukie, told officers he was forced to swerve suddenly off the road to avoid the Holm car which he said was approaching him on the wrong side of the road. The Holm car barely nicked the taxi and went on to crash into the Nelson vehicle, police said. Holm was so' tightly wedged into the twisted steel of his car that he was unable to breathe until freed by rescuers. He died two hours later in a Portland hospital. Rayburn No. 3 in Line for Presidency Washington (U.R) Rep. Sam Rayburn of Texas, a Democrat, will become the No. 3 man in line for the presidency when the new Congress convenes Jan. 5. The ' speaker of the House ranks behind the vice president in the line of succession for the presidency. Rayburn will be named speaker when the new Congress convenes. He will re place Joseph W. Martin Jr., of Massachusetts, a Republican. The president pro tempore of the Senate ranks behind the speaker in the line of presiden tial succession. Sen. Walter F. George (D-Ga.) is slated to be elected to this post.
