Circuit Court Asked
To Void Sentence
Cecil Cannon, 2827 Buckshot
road, who was fined $15 and
sentenced to five days in jail on
June 8 after being convicted of
petty larceny, has asked the cir
cuit court to void the district
court sentence.
He charges a "manifest error"
in that the defendant was de
nied the right of appeal. He also
alleges the sentence was "harsh
and excessive" for the misde
meanor, and that the sentence
must be either a fine or jail
term, or both.
The first sentence by the dis
trict" court was a fine of $50 and
five days in Jail and the tine was
reduced to $15 on the recom
mendation of Deputy District
Attorney Bob Dickey, Cannon's
appeal said, "for the purpose of
preventing an appeal . . . and
that the court erred In giving
said reduction."
The case involved the theft of
one pound of butter from the
Big-Y market.
