The mass sedition case ended in a mistrial today. Federal District Judge James M. Proctor formally declared a mistrial of the seven month old proceeding after a poll of de fendants revealed that they would not consent to continuing with another judge presiding. The special session was held to determine disposition of the case as the result of the death of Judge Edward C. Eicher a week ago. The jury was called In after the poll of the defendants and told that "In view of the death of Chief Justice Eicher in the midst of the trial of this case and the circumstances that have been developed here, the court feels compelled to dis continue the trial and formally declare a mistrial of this case. Only one of the 26 remaining defendants was willing to con tinue. . MONTANA FIRST TO MAKE QUOTA Helena, Mont, Dec. 7 (U.R), Montana celebrated Pearl Har bor day by becoming the first state in tha union to officially go over the top of its sixth war loan E-bond quota. State War Finance Chairman A. T. Hibbard telegraphed Na tional Director Ted R. Gamble in Washington, D. C, that Mon tana's $10,000,000 E-bond goal had been exceeded by $45,000 at noon today and that "at least $1,250,000 more la In transit." Hibbard said Gamble told him that Montana was "not only the first state to exceed its sixth war loan E-bond quota, but is so far out ahead that there Is no competition." 2 E Sam Young, son of Mr. and Mrs. Thomas Young ot Phoenix Jacksonville highway, and Man fred I. Burling arrived at Tula Lake today to start hearings author ized by recently passed congres sional legislation providing that any citizen during wartime may apply to the U. Boy Scout News By C. D. Griffiths, Scoutmaster - Nineteen Boy Scouts of Troop 2 gathered Tuesday at Lincoln school gym for a round table discussion of good Scouting.) Troop Chairman Jack Hunt ley announced he will assist the troop in construction of camp cabins. Edgar Sidwell also of fered to assist. The troop will form at the Lincoln school at 9 a. m. Sunday and plans a full day of Scouting. Dick Hake was elected bas ketball manager with Ted Sid well as coach and captain. Prac tice Is scheduled Friday night at Lincoln gym. Other troops having teams are asked to con tact the manager for games. Scout Wendell Bateman dem onstrated a fine radio sending and receiving set. Charles Wagner and Wendell Bateman are waiting a Court of Honor to prove their ability tor Star Scouts. The troop drew names to buy Christmas presents tor the Christmas party. Scouts not present will draw next Tuesday evening. Parents of Scouts planning to attend are asked to place an additional present for each young member of the fam ily. The troop is looking forward to having as guests of honor next Tuesday Miss Ruth Kiezer of Central Point to assist in some Christmas songs. Loren Soderlund is a new member of the troop. Troop Chairman Huntley promises soon to fill the vacan cy of assistant Scoutmaster with another World War II veteran with previous Scouting experi ence, thus giving the troop a full staff.
