The court, with no dissenting opinion, ordered dissolved a temporary injunction Issued by the federal district court of Montana in the case of Peter Larry Connors, football star at Gonzaga university in Spokane, Wash., who sought deferment from call under ths selective service act. The opinion said the Injunc tion was the "result of an im provident exercise of Judicial discretion" and commented that the draft statute did not give the federal courts "specific au thority over or concerning It." Simons of Log Angeles, whose bodies were found today in a locked automobile near Fresno, Cal.,- were declared "fugitives from Justice" Monday by Fed eral Judge Lloyd L. Black when they failed to appear to begin serving penitentiary sentences for mall fraud. They were for mer officials of the Peoples Gas and Oil company. Marokwitz s brother, Samuel, also an official of the company. appeared Saturday night ready to serve his sentence. The trio, convicted after a lengthy trial In connection with the operations in the Pacific northwest of their oil company, had been given an extension of time to clear up their affairs before beginning prison terms. Saturday night was the dead line. It was extended to Sunday when the pair failed to appear When they still were missing Monday Judge Black ordered their $5,000 bonds forfeited. Samuel Markowitz was sen fenced to three yeara in Mc Neil Island. The other two faced eight year terms and $10,. 000 fines. The three men were convicted In the $1,080,000 mall fraud case In August, 1939, after a seven-months trial. The govern ment charged the men with de frauding some 30,000 Investors, Property leases were sold to In vestors on the promise that there was oil on the land.
