Marshall, army chief of staff, testified to day that there was an "urgent necessity" from a military standpoint for congress to de clare a national emergency un der which selectees, reserves and national guardsmen could V be retained in service beyond . the present one-year period. From the strategic point of view, the army chieftain told the senate military committee, the efficiency of the war depart ment and the military forces would be greatly Improved if congress would act to clear away present prohibitions against longer service. Would Be Tragte To release the emergency soldiers at the end of a year, he declared, would be "a funda mental and tragic error" which would increase the chances of war. The present danger to the nation was "far greater" than when congress inaugurated the selective service program last fall, he said. At the same time, Marshall told the committee it was ab surd to believe he had an Amer ican expeditionary force in J, mind when he recommended continuing in service beyond a year the selectees, national guardsmen and reserves. Testifying on legislation to lengthen the service of the emergency troops, the general said in reply to questions by Senator Austin (R., Vt.) that he would much prefer that con gress declare flatly that the na tion was imperilled, thus giving the war department more "el bow room" in which to work. Nearly 3,000 men waged an unceasing battle on widespread fronts. About 300 separate conflagra tions were reported in 10 of California's national forests, but only a few were in valuable timber and no settlements ap peared endangered. The largest blaze was in the Modoc forest in the far north east part of the state, where 90.000 acres already had been burned over. The fire was still burning today but had not spread appreciably, the U. S. forest service said. Most of the 300 conflagrations were in the five national forests near the northern fringe of the state Modoc, Shasta, Klamath, Trinity and Lassen. Others were in five east-central forests Stanislaus, 1 Dorado, Tahoe, Sequoia and Plumas. as entered may be amended ac cordingly." No Conspiracy Seen The high tribunal said the record is entirely devoid of tes timony tending to establish Mrs. Hanley's theory that Most and Mrs. Bevan entered into a con spiracy to profit at the expense of Hanley or the community. Mr. Hanley is still manager of I uie community, ana ne is me only one qualified to speak for it . . . and any request for re moval of the trustee (Joe Most) must come from Hanley, the court said in answering another request by Mrs. Hanley, As to allegations of the con fession with respect to alleged invalidity of Intermediary con tracts between Hanley and Most, the court said the matters are separate and distinct from this appeal . . . and should be deter mined in a separate suit. As to Hanley the case was re manded as indicated and as to the other respondents. Most and Bevan, the lower court judg ment was affirmed. After trial in lower court, which issued an injunction pre venting disposition of property and restraining other defend ants from further exercising any power under the voting trust agreements, the above referred to sale of stock to Most by Han ley was entered into. After learning of the contracts Mrs. Hanley brought contempt proceedings against Most. In a separate opinion, the court said it was of the opinion it would be better to defer the matter of punishment for con tempt of Most for violating the provision of the order prohibit ing transfers, until it is deter mined whether he also violated the gift provision. For that rea son, the case was remanded to the superior court to proceed as the high court indicated. ALUMINUM MEET SLATED TONIGHT The Jackson County Council of Defense sub-committee in charge of scrap aluminum col lection will meet with represen tatives of various organizations at the Jackson County Cham ber of Commerce at 7:30 tonight to arrange details of the cam paign. Mrs. C. Reese Braley. sub-committee chairman, will preside. The scrap aluminum, needed for defense purposes, will be collected throughout Jackson county July 21-29. Mrs. Bevan has resided in Medford for a num ber of years. Crews had been dispatched to all and no serious trouble was anticipated. The fires were all described as small. The state forest patrol re ported that lightning set 23 fires in this district, ranging from the northeast corner of the dis trict around Prospect and Butte Falls across the northern part Into Josephine county. Sixteen of the fires were in Jackson county, seven in Josephine. None was considered serious. Crews of two to three men had been dispatched to the fires. Thirty-seven local youths have left here in the past three weeks for employment in Pacific coast aircraft plants, the latest group being four who reported for work Monday at the Boeing Air craft company in Seattle. They were enrollees of the local avia tion sheet metal classes being conducted at the high school. The boys were L. A. Hobbs, Sheldon Muir, J. E. Darling and Tommy Natwick. SUSPENDED SENTENCE FOR BT. FALLS YOUTH Douglas E. Jones of Butte Falls, charged with burglary not in a dwelling was granted a suspended sentence in an order signed yesterday by Circuit Judge H. K. Hanna. Jones and another youth of the Butte Falls section were charged with rob bing two cabins in the vicinity. Jones also entered a plea o guilty to charge of dynamltlrr a fish pool. He was fined X2.-, and costs on the latter charge. He has been in the county jail for about two months. The other youth has not been apprehended. Portland Produce Wall St. Report New York.
