10 SUPREME COURT
IN LIBERTY EFFORT
Earl H. Fehl, former Jackson
county Judge, now an inmate
of the Oregon State hospital at
Salem, has filed notice of appeal
to the state supreme court from
an order of the circuit court
signed May 23, denying Fehl's
appeal from the Jackson county
court to the Jackson county cir
cuit court.
Fehl's insanity hearing In De
cember, 1937, was certified from
the county court to the circuit
court by County Judge Earl B
Day, and testimony in the In
sanity hearing was heard by Cir
cuit Judge H. D. Norton. Fehl
was ordered committed to the
state hospital. Through his at
torney, R. R. Hewitt of Salem,
Fehl now contends his case was
never heard in the circuit court.
Circuit Judge Carl Hendricks
of Fossil, heard the arguments
on this contention, and in a de
cision May 23, last, denied the
appeal.
Fehl recently sought a writ of
habeas corpus for his release
from the state hospital. Hearing
on the writ was held in a Mult
nomah county court, and denied.
