Stoudt, whom he Identified as a communist, was an organizer for the CIO union in the canal zone. Phillips said Stoudt was ap pointed to his lob through the influence of John L. Lewis, CIO president, on the recommendn tion of Joseph Curran, head of the maritime union. Hold Key Positions Phillips told the committee that although only about seven to 10 percent of the organiza tion's membership was commu nist, this minority held so many strategic positions it was able to maintain control. The witness, who said he was "illegally", expelled from the union for opposing communism said "American seamen do not like communism," but most of them were "intimidated." Those who openly opposed the communist faction, Phillips said, often lost their jobs by be ing "framed" or were beaten up by "the beef squad." Communist agents "seem mostly to have a lot of money enough to buy drinks for peo ple. Phillips said. Meanwhile, in a police court, William C. McCulstion, who pre ceded Phillips as a Dies com mittee witness in its investiga tion of un-American activities, refused to waive extradition to Louisiana on a murder charge. McCuistion, who has said the charge was a frame-up, was ar raigned on a warrant charging that he .killed Phillip Carey in New Orleans September 17. Granted a 30 days' continuance, McCuistion was returned to jail to await a hearing on Decem ber 5. Declaring communism has crept into "practically every un iversity In the United States,'' Dies announced "eminent edu cators" would be called soon to testify before the committee.
