LOSES FINE ORCHARD
PORTLAND. Oct. 20. (fl) An or
der signed today by Federal Judge
Claude McCotloch permitted Meta P.
Simon, creditor, to foreclose mort
gages on real property owned . by
Hendy Van Hoevenberg, a well-known
Medford pear producer.
Van Hoevenberg was granted a two
year redemption limit to save more
than 200 acres of orchard. There will
be no deficiency judgment and the
Judge said Van Hoevenberg was as
sured the property would be main
tained as an orchard during the re
demption period.
The Judge had granted a stay In
the proceedings last June. In April
he dented a motion to dismiss n
farmer-debtor petition In an effort
to aid the grower who had devoted 28
years to developing the tract. The
court had based Its decisions on the
hope of favorable market conditions
this year and noted that the outlook
hod turned out to be unfavorable.
The Medford Production Credit as
sociation eaftler this year reported a
$14,000 loss on Van Hoevenberg's 1937
crop.
