Junction to restrain the district at torney and sheriff from fulfillment of their order banning plnball ma chines from Jackson county will be heard at Grant Pasa Saturday morn ing. The same Issues Involved af fect both Jackson and Josephine counties. A speedy decision is antici pated. Attorneys for the plnball operators will ask that whatever decision Is made by Circuit Judge H. D. Norton also be made effective In Jackson county. District Attorney Frank J. Newman will participate in the Jose phine county proceedings. The Jackson county order bans the devices after Wednesday. August 25. The Josephine county order ban ned them after August IS. The Jose phine county plaintiff is Earl Bush of Marshfleld, an operator. The Jack son county plaintiff la Earl A. Sims, a local operator. In each suit, the operators seek to enjoin the authorities from con fiscation of the machines, or the ar rest and prosecution of operators or players. The complaints hold that the pin balls contain an element of skill and therefore are not lotteries, that they are protected by patents, and are licensed, and therefore not violative. Authorities contend the devices are lotteries, and in violation of the Oregon state constitution. The removal orders were taken upon the ruling of the attorney- generara office, based upon a de cision of the state supreme court Both Sims and Bush are repre sented by Attorney George M. Rob erts. I EYES SHE ALLEGED SHOOTING The trial of Harry Mackey, chareed with pointing a firearm at another, was underway this afternoon in Jus tice court. The court and defendant and complaining witness visited the scene of the alleged action this after noon. Testimony was completed this mornln?. Mackey Is a rather aged man. The complaining witness is C. L. Myers, a next door neighbor. Myers charged that while he and wife were picking cucumbers late last Monday, Mackey In shooting at Orrie Love's dog, pointed the sawed off shotgun. Introduced as an exhibit, in his general direction. It was alleged the dog was hit. Mackey made a general denial of the charges. It was Intimated that Mackey had resented any trespass on his property and Myers testified he had not spok- Born to Mr. and Mrs. Dean Salt marsh a son early this morning. Friday. August 20. Teng wald as counsel for Eldon Miller, Chiloquln Indian, charged with a statutory offense, and whose Jury trial resulted tn a mistrial, was filed yesterday. Attorney Tengwald sets forth in his request that Miller, for whom he acted as counsel upon court ap pointment, Is now financially able to pay for an attorney of his own, and has done so. Retrial of Miller Is scheduled for the October term of court. The mistrial was declared by the court, after the Jury had reached a Terdict, and was ready to report, and neither of Miller's counsel was on hand. After an hour Attorney Teng wald appeared In court.
