Oklahoma Youth Caught by Arizona Chief Has Been in Jail Often for Car Theft rEDFORD MATL TRIBUNE.- iEDFORD. -OREOOX. WEPXFRDAT. TUTTF, 1, 1937. GALLUP. W. June 3 JP Ouy Osborne, 24-year-old Oklahoma auto thief, paoed the rickety old McKinky county jail today, held for the alay ! Ins t Truett E. Row, young El Paso, Tex., agent of the department of Jus tice. Osborne waa resigned to his fate after capture by a cowboy police chief. "I guess It'a all up with me," he aald when told Howe had died. Then, turning to Police Chief Kel sey Presley, whose gun missed fire as he attempted to halt Osborn's flight yesterday, he said: "I wlah your gun had fired." Osborne waa captured last night a few hours after Rowe was shot In the home of the prisoner's brother. J. W. Osborne, rancher of the Page community. 20 miles south of bei-e. Rowe and Presley went to the ranch home to arrest Osborne on a charge of automobile theft. Presley remain ed In the living room of the home with other members of the family, while Rowe accompanied Osborne In to a bedroom. Presley aald Osborne told him Rowe moved to take a gun from Osborne's belt and Osborne fired, the bullet striking the agent In the right side. The slaying climaxed Osborne's career as an automobile thief. He served twu five-year terms In Oklahoma state penitentiary for auto thefts and was released December 13, 1936. At the time of his arrest he waa wanted In Eufaula, OkJa., and Fort Smith. Ark., on like charges. In 1930, he served five months in Ari zona for violation of the Dyer act. Osborne and two other prisoners escaped from the Eufaula Jail last April. Two weeks ago he came to New Mexico with his wife. Rowe, about 30, had been In the department of justice since March 37. Re was transferred to El Paso from San Antonio. His wife survives. PLAN MASS MEETS BY LABOR FORCES 10 TELL PUBLIC PORTLAND, June 3. (p) Labor leaders discussed today the possibil ity of holding a mass meeting here next week at which opposing forces of the American Federation of Labor and the Committee for Industrial Organization can present their argu ments to the public. It was planned to hare as speakers William Hutcheson. general president of the United Brotherhood of Car penters of America, a bitter oppon neht of the C. I. O.. and John Bro phy, O. I. O. director and aide to John L. Lewis, head of the G. I. O. Hutcheson was expected to arrive today from Seattle, while Brophy and Harry Bridges, coast head of the In ternational Longshoremen's associ ation, were en route here from Wash ington. D. C. Harold Prltchett, Vancouver, B. C . president of the Federation of Wood workers, arrived yesterday, but de clined to comment on whether the woodworkers would affiliate with the C. I. O. at their convention, which opens here Monday. SENTENCE TESTED SALEM, June 3. (TP) Habeas cor pus proceedings attacking the author ity of Justice of the Peace H. Over ton of Wood burn to sentence pris oners to the penitentiary, then sub sequently committing prisoners to the county jail when denied admit tance to the penitentiary, were in atltuted In the circuit court here. The case involves Howard E. Cook and Leroy Randall, youths who plead ed guilty before Overton on posses sion of a stolen automobile. When Overton sentenced them to the peni tentiary Warden James Lewis refused to take them, holding that a Justice had no such authority. Overton then had them committed to the county jail pending a decision. Attorney for Cook started the pro ceedings and the hearing will be held before Judge L. H. McMahan tomorrow. 94.
