Not. 23. (AP) Federal Judge John D. Martin held today that a newspaper la "quasi privileged" in quoting police officers in the Investigation of a crime, In an opinion dismissing a $15,000 libel suit brought against the Memphla Commercial Appeal. The paper was sued on an article published last April which quoted an officer aa saying police wore seeking a man for questioning in connection with the death of a transient. The plaintiff charged he had no connection with the crime and had been damaged as a result of the published story. "The article Itself," Judge Martin said, "was quasi privileged In that It was the quotation of a police officer In the performance of his duty in Investigating a crime. It is not libelous for newspapers to print the news of a police investigation of murder or any other crime." He said that newspapers also might, and should, publish the names of persons police were seed ing in connection with crime so long as they did not wrongfully Impute the .crime to the person sought.
