(AP) The self-styled "Count Du Barry" of Gold 1 Beach and Seattle will have an op portunity next Monday to tell the court his side of the story In the civil action brought by an insurance company which Insists ht delibe rately shot away both hands that he 1 might collect on an Insurance pol icy by reason of his disability. The defendant In the action. George H. Du Barry, who claims to have descended from French no bility and who refers to himself as Count." and to his wife as "The Countess," lost both hands in July, 1933, at Gold Beach, when a shot gun exploded. The Aetna Life Insur ance company, after having made several payments for the disability Is suing to cancel a $12,500 policy Two former employes of Du Barrj had testified that he had offered them sums of money If they would aid In the mutilation of his hands so he could collect on the Insurance. W. R. Hamer, one of the ex-employes, testified, also, that Du Barry , once suggested "driving his automo- , bile into the sea and then disap- 1 pearlng so his wtfa could collect on the policies. The testimony of another of these insurance company witnesses, W. J. 1 Hlmelrlck of Gold Beach, was shaken In cross-examination when a Seattle 1 hotel manager testified he had seen Hlmelrlck and Du Barry conversing in the lobby last December. Hlmel rlck and testified he had nevei talked to Du Barry after the loss of his hands. The defense had asked Hlmelrlck whether he had not mei Du Barry and demanded $5000 from him. Du Barry had Insisted hit ex employes were trying to "frame 1 him beca-tise he could not pay then back salaries. The case la expected to be con cluded early next week. FATAL 10 POUR MILWAUKEE. July 27. fP) Four men were killed today when their airplane fell from a height of 400 feet as the pilot, R. M. Henschen, of Wln netka, III., attempted a downwind landing at Curtis Wright airport here. Henschen and his throe companions all of Chicago were killed Instantly. Witnesses said Henschcn attempted to land with the wind and lost spee:l when still 400 feet above the ground.
