Scorched by the backfire from granges In, Jackson county because he Joined in the petition for review of the L. A. Banks case, peter Zim merman protests that he did not ask for a pardon but for an Investigation. The language of the petition speaks for Itself. Here Is the preamble: "We, the hereunderslgned, citi zens of the State of Oregon, feel ing that the State of Oregon has been a party to an unfair and un just conviction of a man, and prominent citizen, who for many years has been sincerely Interested In the developments of our State, and Is at the present time Incar cerated In the Oregon State Peni tentiary for a crime which he had no remote voluntary Intention of committing: nd who wss convict ed of murder In the second degree on the 21st dsy of May, 1833; re spectfully petition that you can duct or authorize a sincere and ex haustive Investigation into the facts and circumstances surround ing the trial and conviction of Llewellyn A. Banks, formerly of Medford, Oregon, which we trust will culminate In the extentlon of the executive power and Issue a pardon to Llewellyn A. Banks, on the grounds and for the following reasona:" The petitioners ak for sn Investi gation "which we trust will culmin ate In the extension of the executive power and Issue a pardon to Llewel lyn A. Banks." That comes about as close to asking for a pardon as the rules of bad rhetoric allow. One of the reasons cited for the In vestigation of what the petitioners say they feel wss an "unfair and un just conviction" of a man was this: "That at the time of trial and conviction, there was prevalent In Jack ion County, Oregon, and the surrounding counties, intense pre judicial feelings against Mr. Banks. , making it impossible (or him to Transferred to L. A. f f f -': I J V Capt. Theodore Wyman, Jr., at Istant Missouri river division en. gineer at Kansas City, was ordered transferred to Los Angelea, whers he will be in charge of a large flood control program. (Associated Press Photo) Gangster Slain Loult "Two-dun" Altarla (above), gangster and pal of Al Capone In Chicago's pro-repeal beer-running days, was fatally wounded by a ahotgun blast from ambush on a northalde .Chicago (treat, (Asso ciated Press Photo) obtain adequate or complete de fense preparation and a fair and Impartial trial, as a result thereof." What was the background of this feeling? Aside from the murder of Constable Prescott, the hysteria was that whipped up by Banks through his newspaper. It was Banks who pre dicted bloodshed, who dally by wild and extravagant statements fanned the flames of civil dlHcord. Those not of his fold sought in vain to allay the frenzy, to compose the public mind. But the Incipient revolution de veloped until armed men from the hills appeared In the streets of Med ford, until ballot boxes were stolen from the courthouse while an as semblage sang and cheered to divert attention, until a constable was slain with a bullet from Banks gun. The Indications are that the prime purpose of the petition is to create a "cause celebre", to make Banks Ore gon's Tom Mooney and Sacco and Vanzettl, The first signer, and pre sumably the Instigator Is Richard Neuberger, who is politically ambi tious, and who Is purposely assuming the role of Agltator-at-Large for Ore gon. We doubt If he has any sym pathy for Banks, and are of the opin ion that he Is merely seizing the case as a vehicle for agitation. (Salem Statesman). Stretch L'njolnts Shoulder BLAINE. O.
