Ilorun Right Handed Horan, whom the state said was right handed but whom the defense said was almost equally proficient with his left, was found with a gun 'clutched in his left hand. Manning was noticeably Indefinite In his replies to state questioning. He said the excitement of the events and the horror of the tragedy completely upset him. He said it was Impossible for him to state aocumtely distances of ob jects in the offlco at the time of the homicide or his own positions and those of Horan, . KLAMATH FALLS, Ore.. April 25. A quarrel and fatal gun battle In his office February 12 was described to tha Jury late yesterday by Horace M. Manning who Is charged with first degree murder of State Representa tive Ralph W. Horan. You're paying entirely too much attention to my personal affairs and you're telling lies about me" Man ning said Horan shouted at him. Manning said he had counseled Horan to be more temperate for the sake of his wife who was in poor health. Manning said, he prepared to leave ( the office to end the climatic argu ' inent In which Horan accused him of circulating stories about htm and calling him a crook. But as he start ed to leave he saw Horan grab a re volver from the desk beside which he had been seated. - As Horan backed away Manning grabbed the other revolver from the drawer, stooped behind the desk and then raised his hand and took a blind shot after Horan had shot twice, he related. The shot asnerted ly knocked Horan backward Into the chair opposite Manning's desk and the latter raised and fired a second shot. Horan toppled to the floor, kicked convulsively, gasped and then was silent, Manning said. A beautiful exhibit la on display in the window of the chamber of com merce this week by the makers of Alpine Milk. In connection with the display, some interesting Information was divulged today by the Timber Products company. The manufactur ers of Alpine Milk have, during the past eight years, spent over" (300,000 in Medford for box shocks. It is pointed out by officers of the Tim ber Products company that this la equivalent to 3,600,000 boxes which Is equal to 8 train loads of 60 cars each. By making their purchases at the local box factory, the makers of Alpine Milk have contributed a great ! deal towards the industrial develop ment of this city, as the huge pur chases which have been made during the past eight years have been re sponsible for the employment of a large number of men. It was pointed out by chamber of commerce officials that this Information Is particularly appropriate this week, during the state-wide celebration of "Oregon Products Days," and it Is believed that Medford citizens will be ex tremely surprised to learn that one firm alone has spent such a huge sum with the local box factory. Citizens are invited to Inspect the window which is attractively arranged. LOCAL DEBATERS REPRESENT AREA EUGENE, April 28. (AP) The Medford high school debate team will represent the western half of Oregon In the finals of the high school de bats league, according to announce ment here today. The Medford team defeated Newberg In competition here recently. The Medford team Is coached by Ralph Bailey, former university orator. and Includes Irene Btubblefleld and Dolph Janes. The eastern tntgon team will be selected soon, and the championship debate will be held at the university on a date to be chosen after the east ern championship. 4 V. Tries To Follow I Ml AUTO CRASHES PROBED BY POLICE Two auto crashes were investigated this morning by the state police, and no Injuries to the ocaupants were re ported in either case. W. E. Cox of 336 May street and Herman L. Moore of route 1 were drivers of autos which collided on Orchard Home drive. Charles E. Poo, sailor on the U. 8. 8. Oklahoma, trav eling south from Bremerton, and Charles Wilson of Abilene, Texas, fig ured In & crash on the highway at Noll creek. Both cars wore badly damaged. BANK BANDITS ESCAPE DR. LEMERY TAKES Dr. C. W. Lemery, eye, ear, nose and throat specialist of Portland, has taken over the offices of the late Dr. J. J. Emmons in this city, It was definitely announced today. (AP) The Mogadore Savings bank In suburban Mogadore was held up and robbed of 44000 by two bandits shortly after noon today. The robbers kidnaped two clerks And two customers, re leasing their capltves about one and one-half miles north of the city near the Cleveland-Akron road. The captives gave Akron police Illi nois license No. 181103 as the one at tached to Wie car used by the robbers. PORTLAND SEA SCOUTS AWARDED TOP HONORS PORTLAND, Ore., April 25. WASHINGTON, Aprll 25. (AP) The war department announced to day that Lieutenant Colonel Thomas M. Robins, now division engineer, Pa cific division, San Francisco, has been assigned to duty as division en gineer, North Pacific division, at Portland, Ore. PORTLAND, April 25. CP) Two bills by Senator McNary were passed by the senate today, according to a special dispatch to the Journal. One called for extending time for begin ning construction of the five Coast highway bridges to October 1, and the other authorized exchange of about 83,000 acres of Willamette na tional forest to Include land In the middle watershed of the McKenaie river. First of Cherries Come From Farm Near Coker Butte Workers on the Crocket ranch In tho Coker Butte section are the first In the Medford area this year to sing the old -refrain "Cherries ripe, cherries ripe.' A large cherry cup, filled to the brim with fruit, was brought into the chamber of commerce from the Crocket place yesterday, April 24 (If you please). (UP) Re luctance to pay for legal talent to handle Intricate , court- details, did not restrain Lewis L. Heldt, a clerk, from filing a divorce complaint. He took the matter into his own heads. Heldt bought some official look ing paper, borrowed a law book from a public library, atudled the method and drew up its own complaint.
