SALEM, Ore., March 30 (AP)
The old age pesnlon law provides
that parents, children and brothers
and slstera If able to do so must
support Indigent persons, and these
persons If found with other possible
support are not eligible for the pep
slon. Attorney General I. H. Van
Winkle ruled In an opinion handed
Sherman s. Smith, district attorney
of Josephine county.
Under the civil law one exception
la made to this rule, In the case, of
married females where the county
hss no legal right to compel them
to support indigent parents "while
their husbands live." Under the
criminal code, however, all persona
able to support Indigent relatives
and fall to do so may be punished
by Jail sentence and fine, under
which no exception Is made.
Explaining the situation under the
exception, Van Winkle declared that
"If an applicant for an old ago pen
sion has a married daughter whose
.husband Is alive and who Is tlnan
clally able, but refuses to provide for
the care and maintenance of such
applicant, the county court would be
precluded from compelling her to do
so by an action of law, ... but In
asmuch as a mandatory duty la Im
posed upon the counties to provide
for the cars and maintenance of Ita
poor persona It would be the
duty of the old age pension com
mission to grant the pension applied
for, although the daughter may
be subject to criminal prosecution."

Funeral services were held here to
day for Colonel E. Hofer, 79. former
Salem publisher, who died at his home
here Sunday. He la survived by his
widow, Wyona Hofer, two sons, Rob
ert and Laurence, and a daughter,
Mrs. Allan A. Bynon.

GREATEST TRIAL
Aa an Interesting pre. Easter pro
gram for the Medford Rotary elub,
City Attorney Frank Farrell present
ed a talk upon the "The Greatest
Trial In History" at a luncheon meet
ing today at the Medford hotel. In
thla enlightening address. Mr. Far
rel! discussed the legal angles of the
trlsla of Jesus leading up to his cruci
fixion. Throughout the tangled legal pro
cedure. Pontlua Pilate was clearly "on
the spot" the spesker said, and in
hl final action In turning Jesus ovor
to the Jews to be crucified the Ro
man wae motivated by political and
"policy" reasons. The Initial two trials
before the prejudiced Banhedrln were
farcea In which usual legal procedure
waa disregarded. Original charges
were changed first to blasphemy, then
to treason and. when Jesus is defend
ant, appeared before Pilate in ac
cordance with Roman law, he was
acquitted.
When popular clamor again forced
Pontlaa Pilafe'a hsnd, Mr. Farrell told
the Rotarlana how the esse was sub
mitted to Herod who also cleared
Jesus of the accusation, after which
Pilate again was called upon to take
action. The Roman again acquitted
Jesus with "chastisement" which did
not appease hla many enemies, and
Pilate, for political reasons, turned
the man whom he had twice acquit
ted over to the multitude to be
crucified. Mr. Farrell explained. In
this Interesting legal slant upon the
famous "case" how all prlnclplea of
law and usual legal procedure were
discarded.
