Virgil Edlngton, a native son of Ssms valley, whose case was dis missed, testified that after he had entered a plea of not guilty, he met Jones and Arthur LaDleu, found guilty of ballot theft last week, on th second floor of the court house, and that It was suggested "they have nothing on us. If tha three of us get together and form a line of de fense, and stick together we can overrule tha testimony of Wee Mc Xltrlck on his past record." Bdlngton testified that Jones and IjaDleu proposed that ha change at torneys, and he replied he waa "satisfied with Kelly and DeSouza, named by the court. They wanted me to get Enrlght." Jones Persistent Bdlngton testified that later he again talked to Jones, and the latter aald, "though I'm an old man, I am going down fighting and wilt never give up. They only want to get Banks and Fehl and the older heads; they don't care anything about you amall fry They want the leaders." Edlngto'n testified under cross-examination that he waa "guard for Bnnks" and took orders from Wos McKltrlck, "captain of the guards," and related his previous testimony, under dlroct questioning, of taking six ballot pouches to Jones' home at Bogue River, and getting pitch, "to make (he ballots burn better," upon the defendant's suggestion. Bdlngton testified that "McKltrlck and another man went to the wood shed and got the pitch." Attorney Enrlght queried the witness at length o nwhy he had not told this In the LaDleu trial. I. A. He could not Identify Jones aa tha man. but aald, "he waa about my heft." (Jones and Fleming have alm llar physical characteristics.) Flem ing testified, "two big black men were with Jones." He went and got Bryant'a consent to haul them In hla truck. They took five pouches, Fleming testified, and burned th ballots in Bryant's cookstove, and In the woods near Jacksonville. Flem ing said, "we did a good Job of It." Fleming aald, with Bryant and Oaddy. ha had attended the "con gress," and atterwarda went to tha Newa office, and back to their con veyance near the courthouse. Attempts of the state to have Fleming tell of a conversation b had with Fehl about the ballots failed when the defense objection were austslncd by the court. Mra. Nora B. McKltrlck. and daughter-in-law. Mrs. Elsie McKlt rlck. repeated their testimony at th LaDleu trial, of Wesley, LaDleu and Edlngton coming to her horn at Rogue River about one o'clock, and burning tha ballot In the store, Rodney Roach, Ed Walker, and Clarence . Malcolm, member of the atnta police, testified to finding the hsllot pouches in Rogue river, at Bybee bridge and tha mouth of Galls creek. Chief of Police McCredl testified to finding tops of ballot containers In the basement of the courthouse, the dsy after the crime. New Home Loan Bill As Passed by Congress Is Explained in Full Detail No. h In view of tht fact that so many home owners are requesting informa tion concerning the Home Owner's Loan Act of 1033. I am going to out line the main features of the bill as passed by congress and signed by the president last week. I shall at tempt to Interpret the bill to fit con ditions right here In Med ford. There are four terms throughout this act, which should be properly defined as follows: A. The term "board" means the Federal Home Loan Bank board cre ated under the Federal Home Loan Bank act of 1033. This 1s a board of five In Washington which Is ap pointed by the president and has governing power over the 12 district bank throughout the United States. One of these Is located in Portland. B. The term "corporation" means the new home owners loan corpora tion which la to be Immediately set up by this board and shall be an In strumentality of the United States, operated under the direction of the board with whatever regulations It may prescribe. O. The term "home mortgage" means a first mortgage on real estate upon which there Is located a dwell ing for not more than four families used by the owner as a home or held by him aa his homestead and having a value not exceeding $20,000. These mortgages are to be first mortgages, but the bill la broad enough so that people having contracts In escrow may also receive consideration, D, The term "association" means a Federal Savings and Loan associa tion chartered by the board. Before going Into detail of th Horn Owners' Loan corporation, I wish to review the Home Loan Bank bill of 1932, which has repeatedly been misunderstood. Subsection D of section a of this act provide for direct loan to home owners; but without any provision for funds or mschlnery to make loans. This sub section la repealed In the new bill. There need be no expectancy on the nsrt of tha home owner of getting ! relief from the home Josn bsnk, aa ui-h. This bank la now, and alwaya ; was, Intended to be a rediscount bsnk I ror the Institutions which were mem ' bers of It. These Institutions were i limited to life Insurance companies, building and loan associations, and aavlnga banks. The relationship of the home losn bank to long tlm credit agenclea Is Identical with the relationship of federal reserve bank to short time credit agenclea. Tha district bank Is owned by the agenclea and la operated by them Jointly with dlrectora appointed by the home loan hoard at Washington. All district banks are regulated by the board at Washington. In my next letter I will start to explain the feature of the home owner's loan corporation which gives direct relief to tha home owner by the government.
