The defend-, ant assertedly endorsed a promis sory note for $1000, collection of which was Bought by Norcross. In August, 1931, at a meeting, the testimony showed, the defendants aa directors, agreed that three-quartera of a cent should be withheld boxes of peara shipped through Banks and the funds thus secured applied to the Norcross note). The nlalntlff alleged that the three-quarter cent box levy waa col lected but not applied to the note payment. The defense contended that Banks acted a an agent of Norcross and that when the money was collected by Banka they were released from responsibility of the note. All the prlnclpala in the suit are orchardists. and the case attracted much local tntereat. In connection with the case, L. A. Banks, addressed a letter to the court, explaining hla reasons for not ans wering the subpoenas Issued, direct ing him to bring the records of the Suncrest Orchards Inc.. into court. The letter, resds a follows. In part: "I am perfectly willing to be tried for embezzlement In an unprejudic ed court before an unbiased Jury composed of forty-two growers who are Interested In the 1931 fruit ac count. "But standing on my Constitu tional rights, I must respectfully de cline to recognize the suthortly of your court to subpoena me a a wit ness for the obvious purpose to give evidence in a case where I have been openly charged with a crime. The letter waa filed yesterday with the county clerx, as part of the county records. During the course of the trial yes terday, Attorney Porter J. Neff for the defense, declared that the "fail ure of the aherlff'a office to prop erly serve the subpoenas" had pre vented the appearance of Banks ana his bookkeeper, A. J. Blschoff. Bank In hla letter takes the blame, and say the sheriff served the subpoena February 7. Nite FEB. 14TH ELKS TEMPLE Good Music Plenty of Surprises DECISION DELAYED OUT OF ASHLAND No decision was reached yesterday at a public hearing between the state highway commission and the city of Ashland council and property owners, relative to early work on right of way of way costs, Is the chief on atacle at present. The state highway commission gave all concerned a. week in which to reach an agreement on the problem. To this end, a committee composed of Dr. B. Q. Bark well, Irving E. VI n- Ing, C. M. Oreen, Fred D. Warner, F. 3. Whittle, and R. E. DletrHh Mil meet with the landowners at Ash land tomorrow morning, In an effort to adjudicate the matter satisfactory to all concerned. Aocordlng to reports from Ashland. the property owners along the 1.6 miles of the route, ask approximately $50,000 for the land. The state high way commission holds that $15,000 or $20,000 is ample to pay. The county court attended the sea slon yesterday. The county court Is anxious that construction start soon as possible so as to relieve the local unemployment situation. The work will cost about $60,000, which Includes two bridges over Bear creek.
