THIS AFTERNOON
Instructions to the federal court
Jury, hearing the trial of Pat Hogue
and Jerry Marcus of Klamath Falls,
and three youths, charged with con
spiracy in the sale of liquor in that
city, were given this afternoon by
Federal Judge Alger Fee, with the
convening of court. Closing argu
ment were completed shortly before
noon.
Hogue, a taxi operator of Klamath
Falls, and Jerry Marcus, alleged by the
government, to be his "right hand
man," are charged by the government
with entering into a liquor sale con
spiracy, and having used three taxi
cab drivers, of high school age as
dupes in the traffic. The sale of the
liquor waa admitted by three of the
defendants. Marcus and Hogue de
nied the existence of any conspiracy.
The chief evidence against them Is
report of conversations, overheard by,
and with federal prohibition investi
gators. Testimony of the special dry agents
showed that liquor was purchased
through Marcus, who affected delivery
by calling the taxi line operated by
Hogue, and having one of the drivers
make delivery. Hogue denied he
rented the house used as a base of
supplies, but that he paid for the
telephone used In piling orders for
liquor.
Hogue In his own defense, claimed
that he was at Lake o the Woods
last August on the day that the gov-
