Go garty, 73, of Portland, who was struck by an auto while crossing the high way at Blackwell hill Saturday, was reported In an Improved condition at the Sacred Heart hospital today. Mason, who underwent a major op eration at the Community hospital yesterday, was reported getting along well as could be expected this afternoon. The complaint further askA that the Melslnger contract be declared void and unenforceable. (API Funeral services, arranged and re hearsed under the direction of the deceased, were held here yesterday for Peter Rapp. 81, of Holley. Mr. Rapp died at his home here Saturday. "Mourners" crowded the little church here February 11, 1931. when Mr. Rapp'a rehearsal of his own funeral was held. Wreaths and sprays decorated the church. The choir and congregation sang hymns chosen by Mr. Rapp. And Mr. Rapp heard the minister deliver an eulogy, recounting his life history, and lis tened to his sermon on Immortality. Every word of the ceremoy was re corded by a stenographer. Yesterday In the same church, the same hymns, the same eulogy, the same life history and the aame ser mon were repeated word for word. PORTLAND, Ore., Sept. 30. District Judge J. A. Meara today Is sued a warrant for the arrest of C, L. Staley, federal prohibition agent, on a charge of Illegally wearing in signia of the 40 and 8 when he en tered a dugout prior to making a raid on the establishment here September 13, the second rfay of the American Legion national convention. The complaint was signed by Thomas A. Sweeney, a member of the 40 and 8. The warrant was issued under state law which prohibit non-members from wearing fraternal Insignia. O'Rourke, wanted by San Francisco, Cal., authorities for alleged grand theft, waa arrested by the Stat poltce near Oranta Pass on tho Pa cific highway today. Frank Damlco, riding with O'Rourke, and said to be an army deserter, was also held. O'Rourke is alleged to have bor rowed money on an auto and then to have decamped with both auto and money. Army authorities have been advised of the arrest of Damlco. O'Rourke will be returned to San Francisco.
