of the council Tuesday, May 81.
There were but five councilman
'present at the meeting thla week.
A majority vote la required for P
aage and Councilman J. O. Orey
opposed the ordinance. He gave as
his reason elimination of the clause
granting the city of Medford right
to repurchase the aystem. which
was included In the original fran
chise. The three per cent tax upon an
nual Income of the power company,
desired by the council and citizens,
Is included In the ordinance, whlon

California Oregon Power company,
a California corporation. Its auo
ceasors and assigns, the right, privi
lege and franchise for the period or
ten (10) yeara to supply for hire,
to consumers In and throughout
the corporate llmlU of the city of
Medford, as the eame now exist, Ca
may hereafter be established, elec
tricity, for any and all purposes,
and to establish, repair, and main
tain poles, wires, and other appll
artcea. appurtenances and facilities
therein for auch purpose, ana
eonductlng electrical current through
and throughout said city, and over
Its atreeta. alleys and other public
pieces, and to operate throughout
said city as auch public utility, ann
declaring an emergency to exist and
putting this ordinance Into Imme
diate effect upon It approval by
the mayor.

Sec. I. There la hereby granted
to the California Oregon Power
company, a California corporation.
Its auccessors and assigns, for the
period of ten (10) years from the
date of the approval of this ordi
nance, the right, privilege and fran
chise to. for hire, supply to con
sumers In and throughout the cor
porate limits of the city of Meoiora,
th umi now exist, or may hare-
after be established, electricity and
electrical current for any and all

build, repair, maintain and operate
poles, wires, cables, conduite, ana
other appliances, appurtenances and
facllltlea useful for sucn purposes,
and for conducting electrical current

at an elevation of not leas than
twenty (301 feet above the ground.
All auch construction and equipment
shall comply with the atandarda
now or hereafter required by the
publle service commissioner of Ore
gon, or any publlo service commis
sion thereof.
The location of any new power
line or relocation of an existing one.
or the installation of any major
equipment, auch as aubstatlona, shall
be done In such manner aa to be
agreeable to the city, and In con
formity with all reasonable require
ments thereof.
Sec. 8. All statutes of the state
of Oregon, now In force and appli
cable in the city of Medford. gov
erning the establishment and main
tenance of electrical appllancea. In
auch munlclpalltlea are hereby made
parta of this franchise.

Power company In order to make this
franchise effective, shall, within ten
(10) days from the approval of this
ordinance, file with the city recorder
of the city of Medford Its acceptance
of the provisions thereof: no psrtlcu
lar form of such acceptance being
necessary.
Sec. 4. During the continuance
of thla franchise the utility operat
ing under It ahall pay to the city
of Medford a tax upon Ita gross
annual Income earned from Ita ope
rations In aald city aa follows:
Three per cent upon all auch an
nual Income not exceeding atoo.ooo.
and two per cent upon all aume In

There was more freak voting than
usual thla year, but the canvassing
board did not take the time to tabu

vote In this city for president. This
haa been going on for 30 years.
J. C. Thompson received three votes
for constable and other leading
citizens received complimentary votes
for every position on the ballot.
Certificates of election are being
prepared by the county clerk and
will be mailed within the next two
days to the victors.
The official count waa completed
late yesterday, and the final details
will be completed tomorrow.

The eleventh graduation day held

exclusive of Ashland and Medford,
looms large aj Friday approaches.
Prom Evans valley and Copper,
from Prospect and Plnehurst, from
districts far and near, cars will roll
toward Ashland Prlday morning
bearing graduates and tthelr lrlends
to share In the gala day.
At 0:30 the class of 1933 will begin
Ita march from the Chautauqua
building, Boy Scouts bearing the col
ors, school banners flying, high school
band playing, and traffic officers
guarding their way.
The morning program at Junior
high will open at 10 o'clock. The
address to the class of some 360
members, will be given by Walter
Bedford of the Ashland normal
school. Diplomas will be presented
by County Superintendent Carter.
For noon hour, the Ashland park
board Invltea all guests of the day
to enjoy the park to the full. Pic-
ntc lunches there by stream and In
shade, the children's playground
(equipped early to feature the day),
the park pavilion and the afternoon
program there at 1:30, will make the
park the center of attraction for the
mid-day and early afternoon.
At 3:30 the Twin Plunges offer
free swimming fun for all visiting
children. They are asked to bring
their own bathing suite, or they can
rent suits at 10c charge. At that
hour two extra guards will be on
hand to make It safe for all.
Through the festive day children
and their friends will enjoy together
the observance of grade school days
ended, and doors open toward, high
school.

made her home with her grandmoth

on West Eighth street at the pres
ent time.
SALEM. May 26. ( AP) Miss Maiy
Gilbert. 30, who last night commit
ted suicide by hanging herself at
Lawrence. Kan., was the daughter of
L. M. Gilbert, ex-superintendent of
the stat training school for boys
here, and now at the head of the
chlldren'a farm home near Corvallla.
Miss Gilbert waa known aa an honor
student here.
Miss Gilbert graduated from Wil
lamette university in 1025, and a
year later accepted a position In the
Medford high school. She taught
there until last year when she went
to the University of Kansas to take
work for the masters degree In Eng
lish, aha lived at Lawranea, Kaa.,
with her sister, Marjorle. who with
her husband, had received the doc
tors degree from the Kansas univer
sity. Miss Gilbert was prominent In
educational circles here and belong
ed to a number of university organ
izations. Friends of Miss Gilbert
said she waa both attractive and
brilliant.
She also has a brother Malcolm,
living In Portland, and a sister, Mrs.
Cornelius Bateaon In Corvallla.

institution who later took bis own
life In the east.

The choir and soloists from the
Full Gospel Temple In Ashland will
be at the revival services In the
Full Gospel church here tonight,
and will be heard In special solo,
duet and choir numbers. -
Evangelist W. R. Watson will
speak on "The Virgin Birth."
Good crowds have been attending
the revival aervlces. Sunday night
