commander, aatd federal action would

The commutation, however, did not
constitute a pardon and did not re
store to the four their civil rights.
Attorney General Hewitt said, but

Outright Pardon ought
Hewitt aatd he had not determined
whether they could be pardoned by
the president but added that aucn
action would be "an extraordinary
procedure." A move for an outright
pardon was begun by a group of citi
zens. In commuting the sentence Gov
ernor Judd announced he had acted
upon the petition of the four defend
ant and their counsel asking execu
tive clemency. The governor also
made public a petition bearing the
names of 104 members of congress
asking for an unconditional pardon
for the four. The name of Repre
sentative Th a toner of Kentucky,
Maasle'a native state, headed the alg-naturea.
May Drop Charges
The four persona were convicted
last Friday after a long trial climaxed
by Massle's testimony that he shot
Kahahawal last January upon bear
ing the native confess participating
with four other men In a criminal
assault upon tola wife, Mrs. Thalia
Massle.
The commutation probably means
that Mrs. Portcacue, mother of the
attack victim, and the three navy
men will leave Hawaii, and that the
four remaining men awaiting retrial
on Mrs. Maasle'a charges probably
will not be called to face a jury
again on that count.
Massle Thinks of Mother
"My only comment Is," aatd Massle,
"that I wish 1 could be In Kentucky
to see the smile on my mother's face
when ahe learn 1 am free."
"I'd like to tell my friends back on
the mainland," said Mrs. Fortescue,
"that I thank them all for what they
did for me, especially those who
made ia possible lor Mr. Darrow to
come out here.
" am thrilled and very happy,"
said Mrs. Massle.
Darrow, who In his 75th year came
out of retirement to defend the four,
aald ha waa "greatly gratified."
Hawaiian Resentful
Opinions expressed by a few lead
ing citizens reflected the belief that
the commutation waa the best way
out of a difficult situation. The Im
mediate reaction of the Hawatlans,
however, waa one of resentment.

law before them, becomes a farce,
and the truth as brought out by the
prosecution becomes a travesty."
