HERE ARE THE FACTS - c : ., : - o Hon. A. L. Leavitt, Circuit Judge of Klamath County, first came jto Jackson Co&nty to trya case wherein E. E. Kelly had filed an affidavit of prejudice againt Judge Thomas... He r was heVe several times afterwards. The advertisement above men tioned failed to say that Judge Thomas was ordered by the Chief Justice of Klamath County to try the three Scandinavian Hall murder cases and he was compelled to stay there a jjolid month because affidavits of prejudice had been filed against Judjge Lea vitt. Judge Thomas gaife as much time in Klamath County as Judge Leavitt gave in Jackson County. o ' , . Judge Evans of Portland has been senf here several times but Judge Thomas sat on the bench for a month toix weeks in Port land each year. i - ' 1 . An affidavit of prejudice was filed against Judge Thomas in the Swqeney case by A. E. Reames. Judge L. H. McMahon was appointed to try the case. Affidavit of prejudice waalso filed against him. Then Judge Kelly of Linn County spent one day here on the case, by order of the Chief Justice Judge Kelly was followed by Judge Bagley who sat on the case one day. - C Judge Thomas spent three dayl on the Salem bench after af fidavits had been filed agajnst Judge Kelly and against Judge Ramsey of Polk County. Theanext Judge on the list is Judge "Hamilton of Roseburg. He has never presidedPin this district since Judge Thomas was elected, although Judge Thomas has held court at Roseburg. Judge Hamilton did pass on the Rowley water case at Roseburg. When Judge Thomas was in the hospital Judge Walter Ev ans of Portland arranged for Judge Fee of Pendleton' to dispose of some cases here that were ready for trial. v?' 'Judge Skipworth, as every one knows, was sent here to try the Newton C. Chaney case, as it would have been manifestly im proper for Judge Thomas to try this case. Judge Thomas had pre viously presided over Judge Skipworth's coiSht in Benton County. Judge Corkins came to Jackson (County on one occasion to try the Torry-Daniels case in which A. E. Reames filed an affi-. davit d? prejudice against Judge Thopias. Later Judge Corkins, Judge Hewitt, Judge Parker and Judge Walker have aided dur ing Judge Thomas' long sickness and convalescense. Many of the Circuit Judges of the state kindly offered their services to Judge Thomas during this period. - i The judges are paid from the State Treasury and by the stat utes are under the Chief Justice of the Supreme Court and are shifted when available to points where the dockets are crowded. Judge Thomas has held court in many districts of the state during his term and, as stated, has given, by order of the Chief Justice, from six weeks to two months a year away from this dis trict up to the time of his operation in the spring of 1927.
