A about tlie Mitchell case, but they have learned 'considerable
conecriiing court martials.
In tho popular mind, court innrtials have represented, hereto
fore, au arbitrary and rigid form of procedure, Hurroundcd by mili
tary red tape, in which a defendant unpopular with the court, had
no more chance of justice than tho proverbial snow ball. f
It has come, therefore, as n complete surprise to discover that
the present court martial, unquestionably in sympathy with the
prosecution, has shown u spirit of fairness and a desire to deter
mine tho truth which suggests at least that the average civ
court has considerable to learn from army procedure.
There is little doubt that if Mitchell had been trjed before
civil court, n large part of the testimony presented by the defense
would have been stricken out under the rules of evidence. The
prosecution altcmptcd to do this, but in every instauco the cour
martial ruled that the defense should proceed.
In fact, upon investigation, one discovers that a military cour
is not hampered bytechnicalities of procedure, and precedents of
practice, which so seriously . obstruct the wheels of justice in the
civil courts of law. ;
The members of a court martial are given a free hand to get at
the f:.cts and determine the truth. If they are just and honest
men, a defendant before court martial, particularly one without
wealth, has a far better chance of a square deal than a defendant
in civil life.
"Whether Mitchell is acquitted or convicted, there is every reason
thus far to believe that he has been treated with fairness and gen
erosity. .
Incidcntly the trial has demonstrated that the court martial
sfarled from a point, of common sense procedure, from which it has
not departed, and to which it is to bo hoped that civil court pro
cedurc, will, through reforms and technical' readjustments, even
tually return. ,

No discussion of the proper take-out
of partner's no-trump is complete with
out an analysis of the take-out based on
diatribution. Very frequently you will
hold a hand containing good cards and
food help for a no-trump bid, but also a
singleton or(Void suit which makes the
no-trump bid a doubtful proposition.
With this type of hand try to find the
suit bid that best fits the combined
hands of yourself and your partner. For
example, suppose your partner bids no
trump, second hand passes, and you
hold the following hand:

With this hand you 'should bid two
hearts and if your partner bids two no

the prison of the Bastille, Paris.

order to destroy any possible trace
