Counsel for Mrs. Alice Jones Khinolauder. now being sued fur an nulment of her inarriaRe to Leonard Kip Rhfnelandor, on the ground nf fraudulent representation of her race, today admitted In open court that their client had ho me colored blood. The ad m teuton was made by Lee Parson Davis, chief of defense coun sel, at tho opening of his outline of what the defense expects to prove. Hi said: "The 'defense counsel hereby with draws tho previous denlat as to the blood of this dofendant and for the purposes, of this trial and to shorten the trial admits that the defendant has some colored blood." Davis then asked Supreme Court Justice Morschhauser to instruct the Jury to disregard that portion of the outline uf the plaintiff's case made yesterday hy Isaac N. Mills, which re ferred to the mental development of young Ithlnelander, He also objected to the portion of Mr. Mills' outline which case reflection on tho "good name" of the defendant. Justice Morschauser refused to instruct tho Jury on .these points, holding that they were relevant. Mr. Davis contended It was young Khlnolander's father, IMiilln Rhine lander, who wus behind the annul ment suit. "The Khineliindm millions." he said "not Leonard's but Philip's, are hack of this move lo crush a concededly humble family to suve what they con slder to he an ancient nume. trailing back to the Huguenots uf New Ho ehelle. It Is not enough thiit they should entrr this humble home and tnkr this girl, hut because father gets cross about It he had tu drag her in the mud. Mrs. It bluets tutor's counsel said young t-lhtnclandcr forced his atten tions for months on Alice Jones, hud accepted night lifter night tho hospi tality of her family and had met many of her relatives. When the question of marriage uroso Mr. Davis quoted him as saying: "We'll havo to keep this secret. " Alice Jones frequently had express ed doubt as to the advisability of the marrlago Davis asserted. Dtivls said that in meeting Alice's relatives he must huve seen truces of negro blood In them. "Hut yet they say," ha continued, "that he had no suspicion that there was colored blood around." Mr. Davis Intimated that ho might produce letters written by young Hhlnelander to his future wife. If the plaintiffs continued to introduce her letters to him. "If they wish to start throwing mud," he told tho Jury. "I'll wreck this boy by his own letters." Although the dfefensc had conced ed that Mrs. Hhlnelander was of "colored Mood." Khlnolander's attor neys held that It was legally necessary to introduce proof of this nnd Mr. Mills Introduced family birth records, marriage certificate and Insurance ttpplteiitlon. In nil nf these various members of the Jones family were described as "black," or "mulatto." Alice's birth certificate issued In Pet ham In 1X39 described her as "black." Her father's naturalization papers made final ttt described him as a "colored niun." OuthUN Henry I'ord. J TO ALLOW SHOE The property owners of the entire cngth of Riverside, avenue, especially tnoso in i ne section iniui--uwni.-ijr volved, breathed a sigh of relief when it becafne known that the city plan ning commission, at a public hearing last night displayed Its Intention to keep that thoroughfare not only free from the encroachment of business as much as possible, but tu Keep it as sightly as possible. Hence at the hearing pctitfojilng tho commission to change North Riverside between Jackson and Maple streets, from a resilience zone into a business one, the commission turned .1. ...... l. notltl,,.! The properly owners and others in tho section in dispute were well rep resented at the hearlngt Amoroso's pot it if mi was signed by only 11 signers,, including three or four from one fam ily, but the protest petition against, was signed by 1'7 property owners said to be thoroughly representative of the entire district. The commission in making Its unanimous decision held thai t hcrc was no occasion to upset this resi dence section hy ml milting business, and that no emergency existed to grant such a change. I It was tho second time such a poll-' I lion presented by Amoroso had been rejected, and lust night's action was final However, it was reported at the city hall this forenoon that Amor oso had called there and declared I hut he intended to Ignore the com mission's rufing and build at the dis puted focation anyhow.
